Paul, new forum member. Saw a previous post where you were offering some info for another member in the payday loan trap. Wondering if I could pick your brain for more info? I fell into mess when I needed fast cash to pay high insurance deductible after serious injury (horse tried to remove my left hand). Friends who owned animal admitted negligence, agreed to pay in writing, telling me if I could get money to have needed treatment after ER visit, they would reimburse all when they got back into country. This was not done carelessly, as these people have been close family friends for over 12 years and have never done me a wrong until this happened. They returned from out of the country and declined. So I am now suing them and we go to court this summer. In the meantime, I was left holding payday loan bag for a total of $2k (there are 4..internet based). I have contacted all of them, explained circumstances, and as predicted, they could care less. I've told them I could pay out of suit proceeds if I win. Nada. I apid the loans for awhile, until it got to be too much for me to keep up with while maintaining house and car payments on time. So I closed the checking account they have access to and they are STILL trying to debit from it, getting all debits returned and they claim they are charging $30 for each returned item(they debit twice every 2 weeks) and are now going to start adding collections fees. I need to know what my legal options are in the state of Tennessee. I've found conflicting info online and just need to get the facts. As stated, there are 4 loans, total $2k. They are from:United Cash Loans, Multi Loan Source, Integrity Advance, and One Click Cash Advance. All internet based. Any info would be much appreciated.

wellsonce none are legal,or licensed in any state they are illegal.first a couple of questions.

1)how much was borrowed from each
2)how much was debited prior to closing your account.

if line two meets or exceeds line one you owe nothing,but being as these places are illegal they can't charge fees or other charges.they are entitled to the principle borrowed.nothing more.go to the sticky titled DEALING WITH ILLEGAL LENDERS at the top of this very forum.it will give you everything from template letters to ACH revocation letters.to wage assignment revocation letters.just know they will threaten everything,but once you get the letters out can do none of it.

400 from 2 lenders, 500 from 2. All have been backed in excess of the principal borrowed with the exception of OneClickCash. I still owe them $200 and have no problem whatsoever in paying that. I am sending out the letters this morning. The threatenng phone calls have already started. I have heard it all and quite honestly, highly amusing. One company told me 4 large men were heading over to my house. I advised my 4 large dogs would be waiting for them. Another is going to get me fired and yet another said they would 'make your family and friends hate you.' Um, ok. I have also filed a complaint with the State Attorney General's office, BBB, and also the NCUA as my credit union is still trying to charge me $30 NSF for each returned debit that hit after I told them to close my account. Apparently before they did so, numerous debits came in from these 4 companies and the credit union is trying to collect anohter $300.00 Attorney General told me to file with NCUA and also to call today and advise branch manager I have done so to try and get him involved. Letters are being faxed and emailed as none of these companies will give me a physical address and the one that is still owed $200 says they will not provide an address for a check or money order payment. Then like the letter says, no address, no payment!

Since they are illegal you are only morally responsible for paying back the amount borrowed. If you have paid more request a refund. Close your account and then send the letters in the "sticky" thread on how to deal with unlicensed lenders. Please do not send out the letters before securing your bank account!

After I threatened branch manager with NCUA complaint, he got on the ball and closed my acocunt, crediting me all the $30 NSF fees because the teller didn't process close when I asked for it. So, one problem down. I am having an issue with Integrity Advance. They claim to be a Delaware licensed lender and the only info I have been able to find for Tennessee laws is that if they are licensed in another state, they are legal in mine. However, I cannot find a license and they refuse to provide. I'm guessing this is just part of their game?

well just because someone claims to be licensed in a state.that doesn't mean diddly.look at the DE AG,OR DFI websites.if nothing comes up there they are blowing smoke about the license.if it does show a license then yes being in TN you would have to follow those laws,but find out first.

I can tell you that Integrity Advance does have a valid license in the state of Delaware, I found it when I was dealing with them. As for the rest I know that OneClickCash and United Cash Loans are not licensed in any state.

I did find a license listed for Integrity in Delaware. Their state bank listing has it current as of 05/4/2011. Does anyone know if any of the others are TRULY unlicensed in all 50 states: One Click Cash, United, and Multi Loan? I have sent them letters asking for proof and advising ACH auth is revoked based on template in this forum.

okay now that we established integrity is licensed in DE.however oneclick,and united are MTE and not licensed anywhere,and nether is muilt loan.those three are illegal.even in TN.btw yours is the only state with what i call"the loophole"it really stinks on ice.

Who told you that they can be licensed in any state? According to TN Annotated Code, they cannot operated a deferred presentment operation without a license in TN.

When I called Tennessee AG office last week...after being transferred oodles of times..I was told that an internet PDL had to be licensed in ANY state to be legal here. A store front must be licensed in this state, no exceptions. The person I spoke with did tell me that there was a new bill slowly making its way through Senate, but she doubted it would be voted on this term. If passed, it would place stricter laws on PDLs including net lenders, making them acquire state license here to lender to Tennessee residents. From what she told me, the above law applies to store front lenders like Check Into Cash or what not.

Got this yesterday from One Click (scroll down for message). Anyone get something like this previously? They still refuse to give me a physical address. I also received the same message, but a total of $600 from United. Same deal, come to our website and pay. Since they are both illegal in my state, I actually paid United back considerably more than I owed them in principal. They actually owe me a refund, but AG told me good luck in getting that. I told One Click I would be glad to pay what I owe from the principal but I will not give them my debit card number. They will give me an address or they can forget it as I am not obligated by law. I forwarded both emails to AG as they still have a complaint open for me against both.

Having issues with Integrity now. Had arranged a payment plan and I was to be contacted with the physical address as they are licensed in Delaware and I was told legal in my state. They never called me with address. I called them and was left on hold several times. Then got a voicemail from one of their collectors telling me that if I knew what was good for me I would call his extension back IMMEDIATELY. I did to try and get address and he refused to give me address or verify the one I found online was accurate. He advised that the only way for me to pay was by checking account debit. Of course, I refused and told them no address, no payment. That was on 5/26/11. Haven't heard from them since and they have stopped sending me emails telling me account overdue. I filed complaint with AG against them as well to see if someone can either get me an address or confirm that they are illegal in state and I do not owe. I just don't get it. You would think these people would give you a mailing address when you are offering money.

i wouldn't even try to pay them until they get their head out of the clouds.you only owe 200.00 not 830.00,and their pay option is by check or debit card,and the full amount.i know this by my dealings with them.don't budge on this.if they won't accept the 200.00 and an alternate means to pay.then that's their tough luck.

Thanks for the input. That's my thinking as well. I can't figure out what the deal is with Integrity though. They are licensed in Delaware, which supposedly made them legal in my state at the time loan was taken out. I called to make payment arrangements and rep said they would call back with the correct mailing address as it is apparently not the one tied in with their license. They didn't call and I have tried to call them numerous times and keep getting placed on eternal hold. And they have stopped all collection calls and emails to me. Just odd if they are legally owed money. I filed a complaint with AG to see if they could help straighten this out.

yep it's weird,but enjoy the silence from them and wait to see what your AG says.also did you file complaints on the other pdl's as they are illegal and should be reported.
