Hi. I sent this collection agency a letter requesting confirmation/validation of debt for two previous PDLs. I know that I accept that I did do the one from Instant Loan Today and in the letter advised NCA of a payment schedule. The other loan Faxing Payday Loan is one that I do not remember receiving and have no information on this money ever being deposited or my ever applying for this PDL.

I obtained a response on my answering machine last evening regarding this letter and they stated that they would not deal with me via letter or email only on the phone. I thought they had to validate a debt and cannot expect to collect when you do not agree to the debt.

Please advise how to proceed. Thanks!

I previously sent a message regarding this company, no one replied...help, I have written two letters to them and they only want to communicate by phone. I do not remember/have any confirmation of the one debt and am requesting validation on both since I think I may have previously paid off one of these debts.

Can anyone assist?

HI there..
Per the fdcpa, if you tell them not to call you, they need to stop..and if you have sent them a debt validation letter, any calls and letters are considered collection activity, which needs to stop until the debt can be validated.

I dont know the context of your letter exactly, but I would send them this letter below, certified mail and add on the letter that you are logging all of their calls.

DATE

Re: ACCT# <ENTER>

To whom it may concern:

This letter is being sent to you in response to a notice sent to me dated <DATE> Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

This is not a request for "verification" or proof of my mailing address, but a request for Validation of Debt made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following:

1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe
4. Provide a verification or copy of any judgment if applicable
5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:

1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt.

gard, send volley's letter to NCA. They tried to collect on an illegal pdl on me. I sent them the above DV letter. They never responded. I sent a "follow up". They never responded. They also never called me. I haven't heard a word from them again after sending the letters. I went ahead and filed a complaint against them with the BBB and my state AG.

Thank you cannr and volleballmom. I am going to send this letter to them immediately. After further research, I think I already paid the other debt off that I remember receiving.

Thanks again.

If National Credit Adjusters is illegal in your state can they be reported on your credit report? NCA is a nasty company! I sent them the same letters a year ago and never heard from them again...They claim I still owe money on a ipdl I was just wondering if they could report it on your credit report?

As fasr as I know,NCA is a 3rd party collection agency and would just need to be licensed/bonded as such and they can report to the credit bureau. You would just need to disputed with the credit bureau and have it removed.

Here is a link about NCA and the bottom feeders they are.
More people should file suits for fdcpa violations against them. Yourself included!

For the letter mentioned above to fax, are you sending it registered mail, also. They state I need to reply by today? I don't believe I should send this from a work fax, correct. Pls help as I do not want any harassment at work, I am just a temporary seeking permanent employment.

I just sent a letter to them requesting debt validation. I have just formated the letter referenced by Frogpatch at the website that he directed me to. I have not received any confirmation of the debt just continuous phone calls and now the letter for the one debt which I am sure that there will be one for the other debt in the mail probably today/tomorrow. I can't take much more of this.
