ohio rollover payday loans

Are payday rollover loans legal in ohio? I have 3 rollover loans through the internet. 500 fast cash, one click cash, and b&l marketing. I hear that these loans are illegal in ohio, where i live. I have currently paid 240 each on two 200 dollar loans through one click and b&l and 225 so far on a 250 dollar loan through 500 fast cash. They are driving me crazy! How do I get out of this trap?

They can't do a thing to you, except, you will need to revoke any wage assignments you may or may not have signed. The principal amount is all you are morally obligated to pay.

I hope the information below will help you. Smile
You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.

What should you do?
Close your account asap, if you are unable to close your account, go into your bank and ask to speak with the Branch Manager, tell him/her you need a hard debit block placed on your account immediately! Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. This is your privilege, do not accept no for an answer. The following link will provide you important information regarding closing accounts. CLICK HERE

What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. Smile

Thank you so much.. So technically, one click cash and b&l marketing are paid in full already and all I owe is the $25 to 500 fast cash?

That's correct, request their address and send them a money order through USPS, if they refuse (and they will), tell them no address, no payment.

This is a great site. If it didn't exist, i probably would've ended up paying hundreds of unnecessary dollars towards this loan. I'm so glad I caught it in time. Thank you so much shazzers you relieved alot of stress from me. I'll be sure to keep you posted on what happens..

So here's a little update, I have closed my account and sent out all of my c&d letters a little over a week ago. Well since then, I haven't heard a thing from 500 fast cash. I have sent them numerous of emails informing them that i would like to pay back the remaining balance of principle amount borrowed which is only $25, and absolutely no response. B&L Marketing said that they would settle with me for $20 since I had signed the contract for $260 and have paid back $240. I told them that I didn't owe them any more money and they owed me a refund so they sent my account to AIS collection services. I have never heard of it. I also had a loan through zip19 and also, no response. I sent them the same email informing them that I want to pay back the principal amount and they've been ghosts. One click is the only one I've heard from so far and they're being very rude. They're calling my job every day, even after I told them not to, claiming that I owe them another $260. Yeah right. I am not intimidated at all by them but I can't have them calling my job like that. I just need to know if I'm on the right track so far and what should I do next?

You're on the right track for sure. Has AIS collection services contacted you by mail? They are obligated to follow the FDCP, if they have called you tell them they now have 5 days left after the initial contact to send you a Dunning Letter, at which time you may request validation of the debt. If they fail to validate the debt they can NOT continue any collection efforts or they will be violating the fdcpa. CLICK HERE to read about your rights. Smile

No AIS has not contacted me at all yet but I know it's probably coming. The only ones that are contacting me now are one click clash and my patience is really wearing thin with them.. Should I be worried about zip19 and 500 fast cash not responding yet?

I wouldn't be too concerned, sometimes it takes awhile for them to contact you, it could be weeks, or even months in some cases. They will most likely attempt to contact you and try to intimidate more money out of you!

PostPosted: Mon Sep 22, 2008 10:26 am Subject: ohio internet loan sharks

thanks for the info, shazzers. I was trolling for info about pdl's in ohio. I've got some internet based ones and storefront ones also. I've made arrangements with the storefronts, but after reading the Ohio rules, the internets can go piss up a rope. I've more than paid off the principle on 3 ipdl's.

Yes, you can re-borrow after a 24 hour period, unfortunately. Confused
