Debt Validation Letter

Can one of these letters be sent to the original creditor (PDL) or do you have to wait until it goes to collections? Sorry if this seems like a stupid question I just don't understand all of this stuff.

The original creditor doesnt neccesarily have to "validate" the debt the same fashion a CA would according to fdcpa guidelines.

You can certainly send the pdl a letter asking them to validate or tell you how you owe a particular amount. The CA has to cease collection activity once you have issued a DV notice until they can validte the debt according to the FDCPA.

Its a good question...

I thought that the debt validation only could be used on third party collectors- not the original creditor?

I mentioned that the original creditor doesnt have to validate a debt...however, jazzy can certainly ask the pdl how he/she owes a particular amount.

I asked mine for one-some sent them-others not!

I asked for a statement showing how much had been paid, etc. I also asked the store front ones and they printed me out a statement..Karen

Should I assume that if I use the DV letter as a model letter to the PDL that the Fair Debt Collection Practices and the violations listed should be removed?

Actually if it is the original creditor- you won't need a DV letter. Just ask them to provid you with a statemnt showing all the payments you have made since the start.You know the amount borrowed, so take taht, with what they give you as being paid, and see if it is correct..Good Luck.KAren
