How much do I pay?

PostPosted: Wed Nov 28, 2007 10:36 am Subject: How much do I pay?

I've already made arrangements with the legal PDL's, but here's my dilemma...what do I pay the illegals?
I've gone over statments from my CLOSED account, and here's what I've come up with:

Ameriloan- loan- 250.00, paid 150.00
Cash Supply- loan 200.00 paid 730.00!!!! (OMG!!!)
500 FastCash- loan 250.00 paid 535.00 (OMG again!!!)

I've already received a letter from CashTransferCenters where they so graciously have offered to let me pay just the principle on their loan. (AWWW, doesn't that just make me feel all warm and fuzzy!!) Had planned on doing just that.

Thanks,
Jennifer

Jen, I dont. Just tell them flat out they are not legal, you paid them X for an X loan. They will not get amymore. Mark you pif and send refund. I dont know if they will send a refund but its worth a shot.

Can someone post the PDL laws for oklahoma? I can't seem to find them, and on the state site, it's a little convoluted. I need some information to put in my letters. Thanks!

Here's a sample of the letter I wrote to Cashsupply, and will probably send to fastcash as well.

Quote:
Dear Sir or Madam,

ANY DECLARATION OF WAGE ASSIGNMENT, whether real or implied is revoked by myself (my name) for the following reasons:

Technically it is illegal for you to use the wage assignment with a digital signature on it. Wage assignments also have to be signed in person, along with a witness. This is a US FEDERAL LAW.

If I have been served a wage assignment that has been generated from a computer, I have the federal rights to revoke it.

CASHSUPPLY is NOT licensed in the state of Oklahoma. Per the Oklahoma Attorney General?s office, a lender must be licensed by THIS state in order to service the residents, and therefore, is subject to Oklahoma Deferred Deposit Lender regulations.

I have checked my records. I have paid $730.00 on a $200.00 loan. The State of Oklahoma does not allow rollovers on payday loans. Therefore, all payments I have made should be applied to the principle of this loan and the remaining balance of 530.00 should be refunded to me as CASHSUPPLY has been grossly overpaid for services they are not legally able to provide to Oklahoma residents. As I reside in the state of Oklahoma, I am not subject to the laws of your state. I am subject to the Oklahoma law, and so is your company should you do business here? If you do not have a LICENSE to lend in this state, you are not entitled to anything other than the principle of the loan.

I have already filed a letter of defense with my payroll department explaining to them that I have revoked this wage Assignment with your company and they are not to honor it.

I am informing you to CEASE and DESIST from contacting me or my payroll department about this matter at work and only contact me at home by mail. All future communication should be in writing only.

I have filed complaints with the Oklahoma Attorney General?s office and with the Oklahoma Consumer Protection Agency.

Suggestions???
