Just need some advice on how to proceed with these clowns. I'm located in Florida and recently received a $300 loan from them. Due to my own idiocy, I didn't have my payment in my checking on the due date. These guys never leave a message when calling me and have been calling my work on a daily basis. That's even more amusing since they call here at noon and I don't even work until 3pm or later...so they've just been annoying my boss.

Anyways, a week later they refer my account to collections.

As far as what I've done so far...I've sent them a cease and desist as far as contacting me, my employer or my references by phone. I asked them to send me documentation that they are licensed to lend money in Florida (and told them that I know the law and that they can't bs me.) I also asked for a different way to send them the money that I "owe." I told them that if they didn't comply...I'd immediately get in contact with the Florida Attorney General's office, the BBB, whoever regulates licenses to lend money in the state and my attorney.

It's insanity...they sent me two emails in three days. The email they sent me three days ago said I owed $490.00 on the $300.00 loan and the one they sent this morning says I owe $580.00 on the loan. Yeah. Sure.

Any tips on how to respond when they return my email would be greatly appreciated.

So a couple days later they are STILL calling my employer. I bet if my email was about immediate payment they'd be all over that. Anyone have an address or fax number for these guys? Guess I need to mass send my c&d.

Sorry...forgot to sign in for my last post...but after completely ignoring my first email concerning all the info I talked about above...they answered my second cease and desist request.

They said collection calls would stop when I set up a payment.

Really now. We'll see about that. If they wouldn't have ignored my first email they would have read the part where I said "tell me how I can pay without using my checking account." Idiots.

Chosemoney - Impact has been pretty easy for me to deal with after I filed complaints with the BBB and my Stae Dept of Finance. They agreed to have me pay back the principal only and also agreed to a very reasonable time table to pay it back.
It's good that you sent the cease and desist order. No one can call you at work after you've reqauested them not to do so. The original creditor can call you outside of work, but not at work if you've requested them to stop. Did they send you to internal collections or an outside CA? If they sent you to ICollect, that's a real mess. If they sent you to an outside CA, then you need to send them a DV letter right away. They won't be able to validate it becasue they are not licensed and illegal in your state.
I think you're best approach is to pick up the phone and call them, but first file complaints with the BBB and your state dept of banking/finance, saying they are unlicensed and that they cannot collect any more than the original amount borrowed - an not a cent more. Be sure to revoke your ACH authorization. Get any promise they make in writing - either email or letter. Make sure they agree to send you a PIF letter after you've payed back any remaining principal.

As of right now it seems that they've sent it to internal collections for the moment being. As far as I'm concerned, they have until Tuesday to email me back. Too bad for them I'm off work that day and will go to work on being a pain in their arse like they are in mine.

Lucky for them they came to their senses and responded to my emails. I didn't read the first two, but the last one was what I wanted to hear.

Sorry that you were disappointed in your loan. We can also accept payments through money order. We're also willing to accept your original loan amount of $300 as full payment.

That's what I thought. Wink
