Hi,

I have a loan with Purpose Cash Advance, which is based out of Georgia (I believe payday loans are illegal there). I had to close my bank account due to fraud so they did not get their money. I think they may have something to do with compromising my account and personal info. I live in Utah and this company is not licensed here. I e-mailed them and told them I thought they compromised my bank account and asked them how they could be doing business legally.
Do I have to pay back this loan?

Was this an Internet loan? You are morally obligated to pay back at least the principal amount you borrowed. You are correct about the legality, payday loans are prohibited in the state of Ga.

Honestly, you need to close that account, it will never be safe again, you may want to file a complaint with the attorney general of Utah, and the Utah Department of Financial Institutions, they are who regulated payday lenders in Utah and extend licenses, they need to know if this Internet lender is loaning to people in states where payday lending is prohibited.

This is an online loan. I know payday loans are legal in Utah, but I'm confused about whether this lender is considered legal to do business in the state of Utah, since they are based out of GA. Can you clarify?

Utah requires that out of state Internet payday lenders be licensed by your state, I checked the licensee data base and they are not listed, so, that means they aren't legal in Utah. You can check for yourself at the link below:

Thanks for answering my question so fast! I was also wondering, if I have had previous loans with this payday lender, can a ask for a refund of the interest paid? If so, what's the best way to do this? And what laws can I refer to when asking for the refund?

Heck, I wouldn't ASK for a refund, I would DEMAND one. Read the link I gave you on how to deal with illegal lenders, there is a step by step guide on how to proceed.

Hi again! I was just doing some more research about Purpose Cash Advance and they show a registration certificate for Utah on their website, but digging further I found that they are also called Direct Micro Loans, which is registered in Utah. But their registration certificate says Purpose Cash Advance. So I guess I'm still confused about whether they are 'licensed' or not. Can you help shed some light on this? Thanks!
