I have gotten into trouble with these payday loans. I'm losing sleep, I've sold almost everything I can on Ebay to stay above water but I can see the end coming. I really need some help. I am in the state of Florida.

Thanks, I am eagerly awaiting some good advice. I don't know what to do about my bank account. I finally got my credit to the point where I could get a checking account and now I've gone and done this..... I don't want to make any more mistakes.

I, for one if it were me, I would close the checking account to put an end to the ach's...please read this thread before doing so so that you are knowledgable on this works: http://www.debtconsolidationcare.com/paydayloan/close-account.html. Are any of these store fronts? If so they are more than likely doing so legally and you will need to make arrangements on paying them back but looking again at your list I think you have paid more than enough...but like I stated before someone will be along shortly that knows alot more than I do. Hello,

Do internet based payday loan lenders with no physical location in FL need to be licensed by FL to lend legally to FL consumers? I am trying to help a friend with a huge mess. She has several internet payday loans, and they are saying that they only have to be licensed in their state, and that they can follow the laws of their state, not FL's laws. What is correct? Any information would be very much appreciated!

She can file a complaint through our website at flofr.com and under 'helpful information' click on file a complaint. Then click on
finance related and you can download the form. Or click on money transmitters and call the 1-800 number. The Office will review her complaint when received. All lenders must be licensed by Florida, regardless of location, however, the current payday loan laws in place do not address internet businesses. The department is currently looking at other laws to apply to them.

She may also wish to contact Legal Aid in her area, to determine what recourse she may have.

OK....once you have digested the above information and read the notes on closing your bank account,.. You may be able to explain the situation to them and have them switch you to another account and block all debits...but this is unusual. Most of us had to close our accounts.

Looking at your loans they are all paid off and over paid according to your state law except Quick...where you still owe about $68.00.

You can find letters to send to each of them revoking their right to debit your account, stating your law and requesting a paid in full reciept. Any questions just ask!!

Thanks a lot, you don't (or you actually probably do) realize how much better I feel today than I did yesterday. This is literally killing me.

So if I have this straight, I should:

1. Send letters to the PDL companies revoking telephone contact, wage assignment and debiting my account.

2. Get account closed, or open new account. Making sure that the old account cannot be re-opned when the next batch of ACH hit.

3. Go have a heart to heart with my payroll director, giving her copies of all correspondence andmaking her aware of the laws for the State of Florida and to not assign wages to these PDL compaines.

Am I leaving anything out?

Thanks again, I can almost see a flicker of something at the end of this tunnel.

The only thing I would add....close your account first....if they know you are planning that ahead of time they will go in and drain it!!!!

Cue...you WILL be fine. Last June I had 10 internet loans and have managed to close them all out with the help of my family here...

You know...they are the same company and they can be nasty...I was lucky I told them not to call me at work and they didn't. Make sure you file complaints with your states attorney's office...they were great in helping me close about half of mine. Good luck and let us know what you need....

Ok, here's an update. I went to the bank this morning. I had to wait until today as I had a car insurance debit I did not want to screw up. I knew that as of this morning everything would be clear and all legal/authorized debits would be finished.

I opened a new account. Transferred what little money was in the old account to the new account. All of my checks have been voided and my debit card as well. It will take 48 hours for my bank (which is actually an investment account) to generate a new checking account number as well as a debit card and checks.

I have been assured by 2 different employees that no ACH can re-open this account, and that nothing presented will incur an NSF fee or "re-open" the account.

All I can do now is hope they are telling me the truth.

I have filed complaints with the Florida Attorney General realting to each individual loan.

I have written C&D letters to each company pertaining to each individual loan. I used the one I found on this site as a template. I will mail these letters today. I did not want to mail these until I was positive that I had all my ducks in a row pertaining to my bank account.

Is there anything else I should do at this point?

Thanks again, this has been a very nerve wracking week anticipating what's going to happen next.
