I have been trying to dig myself out of the payday loan trap for the past couple of months. I have closed my bank account and sent letters to all PDLs revoking ACH authorization, C&D letters, etc. I have overpaid on most of them, including Payday-Loan-Yes. My loan was for $350, and I have paid a total of $680. I received a call at my work the other day (even though the letters I've sent told them not to contact me at work.) I got her name and called her back after work. The lady says I owe over $400. I told her I had already overpaid them, and they should be issuing me a refund! I don't think they're legal in Ohio, but even if I give them the $15/$100 allowed in Ohio, I've still overpaid. She just wanted to argue with me. She then kept asking me if I was refusing to pay. I told her I wasn't refusing to pay, but that I had already OVERPAID them. She then told me that she was going to mark my account as a refusal to pay and that it would be sent to a collection agency. She then abruptly hung up on me. Needless to say, this really annoyed me, so I proceeded to call her back about 20 times and left her messages each time on her voice mail. She never picked up, but I hope she had a good time checking her voice mails from me demanding a refund for my overpayment. Of course I've not heard back from her since.
But if it does get sent to a collection agency, how do I deal with the collection agency since they don't know that I've overpaid. They just see the balance that the PDL says I owe.

keep in touch with me, i am going through with them right now, they have sent my account to 3 different companies all of which have been on my credit report, 1 of which has been deleted, and i am working on the other 2.

That's what I was afraid of. I don't know how it is legal for a collection agency to buy or take an account that is not even owed! Do you just have to send the DV letter to the collection agency?

Teresa, they sent me to a CA and I requested DV. So far nothing on my credit report and nothing from the CA even though I sent more than one letter....and it has been about 9 months.

i think we had our around the same time roxy, mine has been about that long as well, but the only difference is what you paid them, i believe.

Thanks for the info. I guess I'll just have to wait and see if I get something from a CA. I just really found it quite amusing that a "legitimate" creditor just hung up on me when they didn't like what I had to say. I think that I may resend a letter indicating that I had spoken to someone there and reiterating that I DO NOT owe any balance to them. Or I could just continue to call the lady I spoke with and keep demanding my refund.

you calling them isn't going to accomplish much really, you may as well just ask them for a PIF, and it boogles the mind how these companies buy these debts that are clearly illeagal, i know!

I have 2 payday loans out. I have tried contacting them to make payment arrangements but they will not help me. I have one pay day lender that was so rude to me that I had to hang up on him. What do I do?

Hi there Dendog83 and welcome to the community. Would you mind starting a new topic so we will be able to help you more efficiently, sometimes it's hard to keep track when you post info in someone elses thread.
First of all, please list the following information so we can help you.
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.
I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. Payday loan yes is not licensed and is illegal! I have filed complaints about them to all the agencies suggested. I had many calls from them and they were rude and threatened jail. Well that drew the last straw. They have multiple addresses and phone numbers. If they send you to a collection agency just be diligent and demand a DV. I am still getting emails from them asking to reduce my debt owed by 70%, but in all reality I only owe them $35. I have sent many letters to them, all the addresses and I get them returned undeliverable. Any legit CA will not demand you pay on an illegal loan once they know. Besides they already broke the law and violated your rights. You can not give into them. If they take me to court, which I know they won't, I will gladly see a judge and explain the situation.
I too called one woman back several times after she hung up on me and was rude. She got really annoyed and hasn't called since.

They really aren't worth your time and effort, I wouldn't even deal with them, if you have sent them a letters revoking wage assignments, etc., then I would say it's up to them to conduct business with you in a professional manner to resolve this, if they won't, then wait it out until they do, if they never do, then it is their loss and not yours. You are really wasting energy when you attempt to speak with this company in a reasonable fashion. The anger and threats they display are desperate measures on their part.

It's funny you mentioned the "70% off " email because I got one of those yesterday offering to settle. I'm not settling anything - unless they're going to be paying me, because I've already overpaid. I guess I'll just wait and see if they actually send it to a CA and then deal with the CA then. Thanks for all your replies.

I have learned to not even speak to pdl companies. if they want something, they know where to write me (i'll except their email but no more phone calls!) In fact, I usually do this with all collections, even legal ones (who are still sometimes very rude and demeaning).
If you send them a C & D letter, they might obey it - mine usually have.
As for them contacting your employer to garnish your wages, it's mostly a wage assignment (garnishments are done through court - not likely with an illegeal company!). Please send them a letter revoking wage assignments. I would also tell your payroll. You can revoke it.
