Below is the letter I am sending to the PDL storefronts I owe money to. A recap: I owe 7 PDL companies and have rolled each of the loans over many times, and now I am putting a stop to it. I owe $4600.00 including fees, and I am closing my bank account tomorrow or Monday. The loans are due on April 1st and each of these I gave a post-dated check to. Should I first approach each of these stores to request a copy of the total amounts I have paid them so I can present the numbers to the judge when they inevitably take me to civil small claims court?I reside in Washington state and the state law regarding PDL's is at this link:

Due to circumstances beyond my control, I have reached the limit to where I cannot afford to reloan and pay the fees associated to this loan every month. I fully intend to live up to my agreement in repaying the money I borrowed through your company. My bank account is now closed so the check you are holding is no longer valid. Sending my check to the bank will only invoke a response that the account is now closed. I also am writing to inform you that the only person you are authorized to contact for this account is myself, Robert (Last name) and then you may only contact me via my home phone (***) ***-****. Do not call my place of employment or any other references you may have on file. In the case you still decide to send my check to the bank, and attempt to incur a NSF charge, I will not pay this fee as I am informing you in advance that the check will not go through. Beginning April 5, 2008 I will begin the repayment at $20.00 per month.
I apologize for any inconvenience this may cause your business, but I will not and cannot continue to be trapped in the payday loan cycle.

Rob-I think this looks fine...might want to indicate how you plan on paying the $20.00 a month and by what date each month.
Dont be surprised if they hold you liable for the NSF fee...per WA laws, they can charge you 1 NSF fee, even if you informed them in advance. Hopefully they will be nice and waive it

Thanks! I'm pretty sure they can charge me the fee, but I thought I would just put it in there anyway. Yea, I put the first payment, but didn't put when I would pay the rest of the payments. Thanks for catching that!

I think this sounds good...looks like I will need to be writing one to them too as I had to default today..per my *Urgent* thread.
I have had my fill of being broke and not paying the things I need to pay because of giving them money every week and at this point and as often as I have re-written, I have paid the yearly salary for some of their employees.

rob, the letter is good. It's always a plus to let them know ahead of time that you're not going to be able to pay. volley did raise a good point about stating a date for each payment. Since the first payment will be April 5th, maybe you can say you'll make a payment on the 5th of each month? I can't promise that they're going to "go for" this payment plan since storefronts usually want a lot more than that as a payment plan. However, sending a letter showing your intent on paying in full, sending a payment with it is a great back up in case anything does hit the fan. As far as going in and asking for copies of what you have paid so far, I don't know. Honestly, if they do decide to drag you into civil court, they will have all documentation with them. I know it's best for you to go armed with all you can; however, the point being is that you can't pay them in full - period. So, in essence, you're just going in there to make arrangements to pay what you owe them as of whenever they take you in (if they even do). We're already jumping ahead! You might be surprised. They might work with you. I'm just wanting to give you a little warning that most storefronts will want more than $20 per month as an "acceptable" payment plan (they're words, not mine!). So, don't be surprised if they do contact you and tell you they won't take $20, but will take more for payments. I say mail the damn letters out and see what happens. Maybe some, if not all, will actually work with you on this. I'm all for it. You know what you're up against, and you're ready for it. You've got us to support you. If you run into any problems, just post. We can try to help you out. Whichever/whatever, just please keep us posted as to what's going on. And, let me say, congratulations to you for taking this huge step in getting out of this trap!

thanks everyone! I actually intend on repaying in full in May if my wife receives the money she is expecting from her parents, but really all I can afford right now is $20.00 a month, so they will have to wait their turn to get paid I guess!!

rob, ya do what ya gotta do! You're making an honest effort to pay these debts in full. You have a plan. You just go for it, my friend. Like you said, if they have a cow about the payments, then they'll just have to wait. Good luck to you, rob! Please let us know how it turns out!

Ok folks...the "S" has now hit the fan. I delayed my letters for one month because I couldn’t change my direct deposit in time…I reloaned one last time and now I’ve closed my bank account (closed with no chance of ACH's going through, believe me my credit card company tried and called me pretty quick). I sent out the letters yesterday and today the first voicemail I received they want to call and discuss the payment plan. “$20.00 a month seems very low; why can’t you afford more? It’s not our fault you got in this pickle…can you explain more?”
Now do I tell them that I have 7 payday loans out right now? Or do I tell them as little as possible? These stores will take me to small claims court, so I don’t want to give them too much fodder to use against me. What exactly should I say to them when I call them back?

Well the problem is that all of mine are in-state Store front Payday lenders, so they are all licensed in Washington state. When they take me to court, they can take me to my local district court for a small claims lawsuit. Would it be too much information to tell them that I have 6 other payday loans, or do I just say that I cannot afford to pay, but give no details? I know if I was taken to court, the judge would really have no choice but to rule in their favor, unless I was trying to work with the lenders to pay them their money back...I hope!

Hi, rob! Call the storefront back. Actually, they're being stupid asking such a question. I understand that they will want more than $20 per month. Hell, they all want payment in full! So, just make sure you keep in contact with them. Tell them it's not possible for you to pay more (or whatever they're going to ask you to pay). Actually, all you have to tell them is your having financial hardship. Honestly. It's none of their business WHY you're having problems. Hell, for all they know, a family member could be ill, you could have lost your job, etc. They don't know. You can dream up a story (like you lost your job) and tell them that if you want to. However, you do want to do everything you can to keep the "odds" in your favor regarding making an honest attempt at paying these storefronts. You've got the right attitude. Make sure you stay in contact with them. I would actually write down the calls - when they call you/when you call them/who you spoke to/what was said/etc. This way, you'll have record of everything. But, rob, just tell them as little as possible. They will just go on some sort or tirade if you tell them you have 8 loans out. Good Lord. That's just all the more for them to throw back in your face. So, either just tell them "financial hardship" or tell them you lost your job or whatever you like. My personal opinion? Don't tell them you have 8 loans out.

Thanks cannr: I am just going to stick to telling them as little as possible. Hopefully my wife gets enough money from her parents this month to pay these off right away, and be done with them. I'll keep you posted!!

Hey everyone! So it’s been two weeks since I sent off my letters/closed my bank account and began to dig myself out of the PDL nightmare. Surprisingly, three of the companies have been very understanding (they all think they are the only one; they don’t know I have multiple PDL’s out). They have called me back to offer different payment plans and I have indicated I will get back with them in a couple weeks when I had figured out my financial situation. They were completely fine with me calling them back, in fact one of them said he was just putting my check in the file until June and we could talk then. One of the stores completely pretended not to get my certified letter and started calling my work which I put a stop to very quickly with a threat of legal action. The next store which is in my town was completely over the top! She called me a few times and I told her I would call her back on May 20th. So she kept calling me at home again and again and I just ignored the call. Next thing I know, my wife called me at work and the lady had showed up on my front porch (my wife didn’t answer the door). She placed a door hanger on the door saying “call me back as soon as possible please!”. I called and told her again I was going to be in touch. Stay tuned!!
