sky, you're NOT a "wimp"! You have NEVER been a "wimp"! You were taken advantage off. Push for a refund on USFastCash; however, I will tell you again, they will be a bitch. I was lucky to get a PIF letter from them (through my AG after MONTHS of fighting with them) and I had overpaid my loan. Hell, by then I was like "forget about a damn refund, I'll take the pif letter"!!! I'm glad we've given you courage! That's what we're here for! To help you and to also let you know that there is a way out of this nightmare! Whatever you need, just let us know. We'll be here to help you!

What state do you live in? The laws go by your state laws not the laws of the state the pdls are in.

I thought I could file complaints with OK & NV's AG too, but if the pdl are legal in their states, I guess it wouldn't do any good. I am in NC

Just my opinion, It never hurts to file where ever you can. I filed on mine in their home states as well.

Well..I did it. Although my stomach is still in knots
and I sat in the bank's parking lot for 30 minutes, I finally went in to the bank and I did it. I spoke with the branch's asst manager, a Mr Allison...he handled it a little differently. He did do a ach-stop pay block on both the pdls...at no charge. I am to go in tomorrow to set up a new cking acct (free) that he assured me would not be linked in any way with the old acct that will be left to sit, void of funds but with ach-stop pays, on both company ID#s, be good for 6 mths.
He told me each pdl lender has a company ID # and regardless of the varied names they can use (easy to do), it is difficult to get multiple company ID #s.
I still wonder what's to stop a pdl from sending a debit to an affiliate pdl with a different company id # and that debit going through my old account. I guess since the bank has the ach-stop payment/block
on the acct now, if they let it go through, they have to reverse it and refund any nsf fees.

So my next step is to write the letters with copies to the NC AG, BBB, NC Banking and FTC...right? Email and regular mail certified right? Then file complaints directly with the NC legal entities and BBB? I'm a little weak in the mind right now.

Yeah, um, they do have different ID's . . . . That is how they get around the stop pays people put on. Another thing they will do is send through a paper check to get around stop pays.

Is the account closed now?

Ok, I'm back. For sure you know that one pdl lender can have multiple company id #s? Not to dispute your word, I just want to understand completely. My acct now has the ach-stop payment block on it for the 2 pdls...what we do tomorrow with the current acct I'm not sure of, but I will make certain it is either closed with stop-pays good for 6 mths or a will insist on a hard debit block. Will this work? Even if they try to send a debit back through with a different company id #, it will take more than a day...they shouldn't get the stop pay notice until Monday right? I have to get the new acct set up for my direct deposit....actually, I did send in an appl to a local credit union Wednesday so I might end up with 2 accts to choose between for sending my paycheck to directly. Wouldn't trying to send back through a debit with a different name & company id # be fraud?

A debit block will stop anything from going through, unless it's putting money into the account. Nothing can come out. Even if there was money in there you wouldn't even be able to withdraw without removing the block.

The problem with the stop pay on the ach is that payday lenders are used to them. It will stop them for a bit - But depending on the company, yes they do have different id's, and/or they will just send through a check, which will circumvent the ach stop pay.

Using a different company ID would not necessarily be fraud. If the same parent company owns both subs, then it's all the same company anyways. But each company will have their own id#, bank accounts, etc.

When you talk to the bank, ask them about freezing your account. If they still say no, ask them what they do when they find out a customer is using their bank account for fraudulant purposes. The answer? They freeze it! They put a hard hold, or a freeze on the account so that it can no longer be used. Don't take no for an answer.

But it is ok to close the account with an ach stop payment on the pdls? No forced ach or check will go through? As long as all transactions have cleared, I am within my rights to close the account right?

Skymerle here...

Ok, checking account is closed, new account is open.
I was assured that there was no way any pdl would forced open the closed account with either an ach or a check. I was assured there was no way my old account would be linked, in any way, to my new account...no way. Everything is documented for any processor to see. The $30 stop payment fee was waived, new checks cost waived..have new checks and dr card coming next week. This was Wachovia...a bank to consider, and my credit is not the best.

btw, I am also asking for refunds of any overdraft fees caused by the pdl...this will be in addition to overpayment interest/fees they sucked out of me.

I prayed to my dad in heaven to help me get out of this mess. I think he did help me..he guided me to you guys. Thank you. Sky

Now the fun/fight begins...ya hoo!!!

HI,
does anyone know the phone number to customer service, a live person!, so I can contact them about monies that they have been taking out of my checking account. Has anyone had any problems with them, as far as them taking out monies, when I dont remember taking out a loan with them. You cant find a phone number to contact the. My bank told me to issue a stop payment on the deductions, has anyone done this? any help would be gratly appreicated!!
