Sub: MTE Financial sent me this email

I just received the following email from MTE, in response to my Revoke Authorization letter. My original loan was for $300.00, I have already paid $180.00, how I see it I only owe them $120.00, not the $300 they are requesting. Am I correct? How should I respond? Thanks!

Ms. removed,

We have received and reviewed your correspondence regarding your complaint with the company.

The money was lent to you in good faith with the understanding that you would abide by the terms detailed in your loan contract. We upheld our end of the agreement by crediting the funds to your account in a timely manner. The Loan Note and Disclosure that you e-signed and thereby agreed to is very detailed and clear so as not to cause any confusion to the borrower, and meets all the Truth-In-Lending and Reg Z requirements as prescibed by Federal statute. In addition, the Legal Disclosures provided for customer reference at our website state the following:

Regardless of where you may be viewing or accessing this site, you as the borrower are responsible for complying with any local statutory obligations that may exist in your state or area with respect to this transaction. The Federal laws governing this consumer loan agreement may differ from the laws of the state where you reside. If you do not want to enter into a consumer loan agreement with us under our terms, then you should apply for a loan at a provider located in the state where you live.

Due to the fact that you have revoked authorization on our debits, no further debits will be made from your account.

In the interest of resolving your complaint in a timely manner suitable to both you and our company, we have agreed to waive the finance charges currently due on your loan. We will expect complete payment of the principal amount owed.

The Lender will be prepared to provide you with the information necessary for repaying the $300.00 that remains due on your principal balance. Payment must be received by you in the form of a Cashier’s Check or Money Order payment. We expect this offer will bring us to an amicable resolution.

Please acknowledge your understanding and acceptance of our proposal if you are in agreement with the offer detailed above, and advise which payment method you will use. Once your acknowledgement/agreement is received, we will provide you with the information needed to make the payment. Once we have received this payment, we will mark your account "Paid in Full."

If your response is not received within seven (7) days of the date of our offer, the offer will become null and void and collection efforts will resume.

MTE Financial can only charge you any legal fees if they are a licensed business in your state. But they have a number of complaints in most of the states and prohibited from doing business. Read this link

You need to inquire about their licensing registration and send a copy of the letter to your state attorney general. They are required to prove their business as legit before they can add further charges on your account. At this stage, you are required to pay the balance amount on the principal.

Thanks for the info...in my Revoke Authorization letter I did ask them for their WI License number, (I'm in WI) I also stated that if they didn't have a WI license, to please provide me with the states that they were licensed in, and the corresponding numbers....of course I never received any of that...I will send all the correspondence I have with them to the Attorney General in WI....I'm just wondering how to respond now, they are giving me 7 days...Maybe I'll write them another letter, saying I filed a complaint, and I will only pay them the balance on the principle, and see what they have to say to that.

Yes, mention the point and send a copy to the AG's office. In my opinion, draft a separate letter to the AG explaining the whole situation. This will help them to do any investigations on MTE Financial regarding your case

MTE Financial uses different DBA names while hitting people's checking accounts. Be careful if you see any suspicious activity by them.

The list will continue because these scam companies know that they are busted and people have become more informed about their illegal business. If they have to remain in the business, they will have to find out new DBA names

I guess they realize they don't have a leg to stand on, that's why they're trying to make a deal with me...not a very good one from my point of view....I'll think of good response to send to them tomorrow, my brain is kind of fried right now. Super busy at work. If I responded to them today, I would probably have to quote Anthony! Although that might not be a bad idea anyway! Thanks for all the advice everyone, it is very much appreciated.

teri, take the day off. Send them a reply tomorrow. Be sure to keep in mind that they are not licensed/legal. I like to keep reminding them of that, myself! And, honestly, as anthony stated, you are not LEGALLY obligated to pay them squat. The majority of people pay the principle amount back only. You do what you want to do. But considering they are way illegal and you legally don't have to give them a dime (and you can always quote anthony!), don't let them scare you/harrass you into paying more money. They are soooo notorious for this. You take out $300, they want $560. But they will FOREVER try to debit your account.

Thanks for the pep talk Cannr....I'm definately going to try to put it out of my mind until tomorrow...I'll respond to them tomorrow, when I can think straight. I will definately let everyone know what kind of response I get back from them.

I am in WI, too, and dealing with Canr's favorite company, MTE. I know that this sounds bad, but it's almost better to wait and see if MTE will forward the account to a collection agency, they work with ARM (Accounts Receivable Management). That way you can send a debt validation letter and if ARM cannot correctly validate the debt, they cannot collect on it.

debt, that's not a "bad" thing to say! I have to laugh! Because, honestly, dealing with MTE (for most people, not all) is like banging your head against the wall. They are not reasonable. At least if they have to provide debt validation (which I find hilarious) you have a better chance with them. I just have to laugh at MTE anymore because they soooo come across as "doing business" when they are one of the most illegal of all!
