Please forgive if wrong thread and redirect?

I requested a 300.00 loan online several months ago and to my surprise found they deposited 900.00 in my account. When questioned I was told I could pay 600.00 back WITH INTEREST and roll the originally requested 300.00 into a new loan, right.
I delayed and eventually defaulted when my car needed to be replaced....now being harrassed by "legal mediators" who say they are with an attorneys office and I have limited response time before they turn over to local jurisdictional court for charges to be filed......incidentally they want 1765.00 for my 900.00 loan.
Any advice? I am in Dallas, TX.

Thank YOU! After one very long year of harrassing calls and threats of going to jail, etc etc....I learned from an actual attorney today that me living in North Carolina and it being illegal to do PDL's here, I dont even have to pay back the amount borrowed. Most will pay it back to feel better but with the harrassment of them getting every cent and STILL taking more than they said over and over and me losing 3 bank accounts, now owing the banks of course(all return fee's), the attorney said to let them sufffer with the measily amount they loaned me. We dont even have to contact them to let them know we arent paying it and we arent tolerating them. Change the phone number however annoying it may be. I dealt with 5 companies that not ONE of them would contact me by real mail, only harrass me by phone. My Human Resource person with my job also said when anyone calls to verify anything on my husband, she has marked his file as a "dont tell a thing" type deal. Ive been up for hours and days trying to rack my brain. I didnt know about this site. Im so glad its here. For those who dont believe what you typed, they can see an attorney for free OR just see if its legal to do payday loans in your state. If it isnt, then tell them to ..well, you get the idea!
Thanks for posting that, I couldve typed word for word what the attorney said but you summed it up perfectly!

First, find out if payday loans are legal in your state. If they are then you ONLY have to repay them if you went to their place of business and handwrote them a postdated check. All they can do at this point, even if its all legit (but Im guessing they are not or they wouldve had you arrested already if its been this long). There are also amounts they cannot get from you, such as...you borrowed 900 and they want back almost double. There are laws that say how much interest they can charge. Im guessing since its been a few months, they arent legal at all. Our attorney told us when they arent legal, you basically have the option of paying back ONLY what you borrowed or let them suffer and lose it because they harrassed us. Find out if its legal. Im googling it and your state is listed as legal, but the list was from 2006 so that may have changed.

I did what this site advised me to do - I closed my account, sent them a c & d letter by fax and by mail. I borrowed 350.00 on 6/22. Then paid them 2x per month 105.00. I paid them 525.00 all together before I got advice from you guys. Now Jan. 13, 2010 I have some obnoxious lady by the name of Lori White calling my work # and my cell # saying that she is an independant processor and is going to serve me papers for writing a check with intent to defraud and several other things. Can't remember exactly what (I became too angry to remember). Then I called 888-358-2080 (The BAM Group) and Stepanie insisted that I now owe over 600.00 in late fees and the amount of the loan. She also wants me to get a pre-paid debit card or ask a relative for use of a cc or debit card to remit payment. How can I make this stop????? I have all of my bank statements that show how much has already been paid to these people... I am going crazy - they tell the entire story to the receptionist that answers the phone and talk to mw like I am a dog!!!! I cannot take anymore!!! HELP!!!! BTW - I live in Mississippi.

You can't make them stop. All you can do is NOT speak to them under any circumstances, hang up immediately when you find out it's them. The less you speak to them, the less they will call. What they want is someone to argue with, don't give them that. You did the right thing, but just because you did the right thing doesn't mean they will. They are nothing more than criminals, remember that when you receive a call from them. Report them, file complaints with the FTC and your AG. Ignore them, that is really all you can do besides have your phone number changed.

I just got a call from BAM GROUP. they left me a message stating that they want to work out some deal with me since its tax season. They can "Settle", otherwise they will have to take "LEGAL ACTION" against me for writing bad checks? First of all, I NEVER wrote any bad checks. And its a payday loan. I paid it back and it should have been done. A couple weeks later, it deposited funds BACK into my acct w/out me requesting it. Unfortunately, my balance was in the red so it absorbed it. I didn't check this acct and didn't even know for months. Eventually the bank closed my acct for no activity. Then I get calls from BAM Group 2 years later. Can they really come after me? I didn't know. Or are these just collection threats?

can they really garnish your payroll check or bank account?

Hi how long would the sentence be if someone tried to open a business account take a loan from bank and then declare my self bankrupt? the person is trying to scam £150,000!

I am from South Carolina, and I am going to about 5 payday loan lenders.. This Feburary a new law has passed in my state that says you have to pay off all of our cash advances and stick with one.. I want to pay them all off... I am losing money hand over fist and about to lose my car... I am trying to get the money up but i have pay credit and I don't want to end up jail with a check warrant if i can't get the money up i need some legal advice on this issue and i can't get a straight from anyone in this STATE... Please any info is appreciated.

Please start a new topic and include the following info, this will help us to help you:
-Names of each pdl company.
-Whether they are store front or Internet.
-How much you borrowed.
-How much you paid so far.
-The state in which you reside.

Received a call today from a man with a thick accent stating he was with a law firm. He started the call by reading what he claimed was an “affidavit” and proceeded to state I was being charged with bank fraud, etc. for not paying on a PDL with a co called Fast Cash International. I told him I didn’t recognize the name and asked for more info. He couldn’t give me any specifics on the loan. However, he was able to tell me all of my personal info! I told him I would need to look into this matter, but if the debt was valid, could we work something out. He said no. I asked him what purpose of the call was then, and he said to inform me of the supposed affidavit. He said they were pressing criminal charges. I got scared, and asked if there was something we could work out to avoid criminal charges (stupid on my part). He said I would have to pay the balance of more than $500 that day with a Wal-Mart prepaid money card. Red flag. I said I would call him back. I Googled Fast Cash International and found numerous fraud complaints. They try to get money from people by stating they are being charged fraud by not paying back a loan. When people refused to pay, nothing, of course, happened. I called him back and told him I believe they are a fraudulent co and that I have contacted my state’s attorney general office. He said they weren't fraudulant, and I asked him to provide me with info to show they weren't. He stated they would have to proceed on their end and hung up.
Anyway, while I don't think this company is real, I have become very worried. I have had online PDLs, and due to an illness, wasn’t able to pay and my bank account was closed. However, after negotiating with them, things are settled or almost so. I don’t, as far as I know, have any “outstanding” loans. Even though I know this particular company is fraudulent, can companies pursue criminal charges against me??? My account did close and they tried to process payments. These were returned. Can I be charged with passing a bad check??? They scared the heck out of me, and I am in need of a little reassurance. Thanks, and sorry for the long post.

payday loan. i have one i borrowed 470.0 on and i could not pay it back so i have been making payments. i stopped making the payments for a month or so because my dad was dying with cancer.my life was turned upside down. i owe them $225.00 right now.
i got a letter in the mail telling me they were going to take civil action against me. can they do that after excepting the first payment,. It seems as if they broke the contract as well taking a payment from me. i have made actually several payments. small they may be but payments.

I did contact the commission of the dept. of financials institution of frankfort kentucky and i was advised by them to let them know i have been forwarded to the fair debt collection practices act governed by the federal trade commissions. they keep calling my mom and friends and family harrassing them to reach me.

I was told that they can take me to small claims court to garnish my checks but can not criminally prosecute me.

which what i wonder is the first of my question. even after they have excepted a payment they can still do this?

I have one onf my employees who recently brought it to my atention that he has 18 loand from 18 different companies. He in no way makes the $7000 a month that comes due. In fact each month he has more he takes out. colorado allows for only one loan. Is this law for both the lender and lendee? Do I need to worry that he might be arrested.

for one thing you can't be arrested or have criminal charges filed against you for a pdl.i'm guessing these were done online.if so chances are that they were illegal.therefore the most they can do is a civil action,but the fact that this person is in INDIA and being your loans were more than likely illegal all anybody will do is call and stupidly threaten you.if they do hang up,and file AG,and FTC complaints.i would do that to whoever called for FAST CASH INTERNATONAL.also don't speak to them again one of your pdl's gave them your info for spite.
