Unless you really did intentionally defraud a company by fraudulantly taking out a payday loan (using false info, etc) you cannot go to jail, be arrested, etc for a payday loan.
These places will try to scare you into paying up. They do this because they know there's no other way to collect legally on the debt, so they resort to illegal scare tactics to collect. There are no debtors prisions. Can you imagine how crowded the corrections systems would be if everyone that owed money and had defualted went to jail? Know this - You cannot go to jail for not paying a payday loan debt. No police will be showing up at your work to arrest you. Your kids can't be taken away. These places are going to tell you the most awful things they can think of to scare the hell out of you and get you to pay. __________________

So, please do not be intimidated by these lies. They cannot do anything to you. The worst has already happened (the phone call being the worst). All they have are words, empty threats.
If you want, you can call your local police department. Ask them if you can be arrested for defaulting on a payday loan. They will tell you no. Now - In some states they do allow for bad check charges relating to payday loans. But - This is a check. They must have a physical check that bounced. This would mean it would have to be a storefront. And usually, as long as you keep up communication and stick to a payment plan, the storefront isn't going to do anything. __________________

I HAVE BEEN RECEIVING THREATNING PH. CALLS FROM SOMEONE SAYING THEY ARE FROM THE NATIONAL PROCESSING DIVISION AND THAT I OWE 1500.00 FROM A PAYDAY LOAN. THEY TOLD ME THAT THEY WERE NOT GIVEN INFORMATION AS FAR AS WHO IT WAS WITH OR WHEN THE TRANSACTION TOOK PLACE ONLY THAT IT WAS SOMETIME IN 2007. THEY WANTED ME TO FAX THEM SOMETHING AUTHORIZING THEM TO DEDUCT THE MONEY FROM MY CHECKING ACCOUNT USING MY DEBIT CARD. THEY SAID TO FAX IT TO THE LAW FIRM OF US NATIONAL BANK 949-743-8902. THE NO'S THEY HAVE CALLING ME FROM ARE 818-336-9382, 213-992-3503 AND 408-688-2091. I BELEIVE THEY ARE ALL FROM CALIFORNIA, I'M FROM PENNSYLVANIA. I HAVE BEEN IGNORING THEM SO FAR. I HAVE A CLEAN RECORD WITH ANY PAYDAY LOANS THAT I HAVE HAD. THEY LEFT A MESSAGE ON MY CELL PHONE YESTERDAY SAYING THAT IF I DID'NT RETURN THEIR CALL IMMEIDATELY THAT I SHOULD GET A LAWYER FOR MY OWN SAFETY. THEY ALSO SAID THAT IF I DID'NT COMPLY THAT THEY WOULD SEND SOMEONE FROM THEIR LEGAL TEAM TO MY PLACE OF EMPLOYMENT. SHOULD I CONTINUE TO IGNORE THEM OR THIS SOMETHING I SHOULD BE CONCERNED WITH? AND HOW DO I STOP THEM FROM CALLING ME AT WORK? THANL YOU.

Ummm...first rule of collection...no validation, no payment!
The fact that they said "they were not given information as far as who it was with or when the transaction took place" should be your first red flag. Since even THEY don't know who or what, why would you send them ANY money until they can validate! Get their address and send them a debt validation letter. Until they can provide who the creditor is and what it is for, they can go pound sand. Second, I would save the recording and file complaints with your states AG, FTC and BBB. |

Call them and ask them. If they won't give it to you, the heck with them! (If they won't give you their address, make sure you put that in your complaints to the AG, FTC & BBB.)

I received the same call with the same number and fax number. He was very intimidating and said the same things to me. I tried several times to get a physical address from them but all I could get was they were based out of California. I contacted the BBB, Consumer Rights, and FTC. I also had to close my account because they had my account information. I realize this is probably a scam but it is still a little scaring. I really would like for someone to tell me without a doubt this is a scam.
