i don't know how to get out of this payday loan mess. i have tried to make payment arrangements with these people, but they all say i have to pay in full through western union. i had one company call my job yesterday and threaten my boss. they told him since he verified employment, that he became part of the contract, and that they would be serving me and him summons to appear in court today, in california. we live in maryland. can they do this? my boss has nothing to do with this loan.

No they can not and they will not. The reason they do that is to black mail you into paying. GFSIL and its related companies are notorious for doing this crap so without you actually posting the company name I am guessing it is one of theirs. I would not pay this company another dime especially if it is GFSIL. Report the company that did this to you to the BBB, the Maryland AG, the California AG, both states office of finance, the FTC, the FCC and any other agency you can think of. It would also be helpful if you posted the amount you borrowed and the total amount you paid back so far. This will allow someone on the boards to determine if you paid what you owe according to your state law.

No, they are just trying to scare you. They tried to tell me the same thing. But just because someone verified employment does not make them responsible for the debt! Follow Dollarsandsince's advice . . . . . PDL's are prohibited in MD, so filing those complaints could really help.

Dang you guys are quick. If you could make a list and post it of each company, the amount you borrowed, the date you borrowed, the number of times the loan has gone through roll over and the total amount you paid to each. We need to compare this to your state laws regulating what they can legally collect.

I posted this for you on another thread. did you post more than once?
First you need to send cease and desist letters to these people, asking them to contact you only via mail. Explain to your boss that these are illegal companies trying to take your money. They can not and will no be able to take him or you to court, These are idle threats made to scare you into paying .There is really nothing they can do except harass you.Your boss will have to understand this. He is not responsible for your debts. You need to read the thread above regarding closing your checking account and opening a new one, so the debits will stop.
Please gather all the requested info, so we can better help you.

Hehe. It looks like Goudah has the state law part covered. File the complaints and make darn sure your bank account is locked up so they can not ACH it. I would recommend getting a new account at an unrelated bank and using it for any future transactions. Do not use it for any PDL’s or it will start the cycle again and you risk one of the old companies figuring out the account number.

Once you file all your complaints, send cease and desist letters and send copies of the complaints to each company they tend to back off and either settle or give up all together. If PDL's are illegal in Maryland then you legally owe nothing. These companies have two options to get money from you. First, they can call and harass you into paying which is not legal. Second, they could try to sue but the suit would be in Maryland and they would lose since the loan was made illegally. If you feel a moral obligation to pay them I would pay the principal only on your terms after you pay all essential bills associated with food, transportation and shelter.

Here's some info regarding MD law:
| Quote: | Thank you for your e-mail letter regarding payday loans. Please be advised that payday loans are not permissible in the state of Maryland. Additionally, such loans are consider consumer loans subject to the Maryland Consumer Loan Law, Title 12, Subtitle 3, Commercial Law Article, Maryland Code Annotated. Additionally, a person who makes a consumer loan is required to be licensed, unless exempted from the requirements of a license.
Also, you should be aware that any person who violate Maryland law may not receive or retain any principal, interest, or other compensation with respect to the loan.
I trust that the above information addresses your concerns. If I can be of any other assistance, please feel free to contact me directly at 410-230-6017. |
Your bank account is closed, right?

If you have enough money then send your letters certified mail return receipt requested. I think it cost $4-5 each.
