I am so glad I found this site
I have been in PDL HE** for a few years now. Much I won't go into But am hoping someone can help me with my current situation-
I am Self employed single mom, exempt from garnishment due to income level and state aid received.
Check Advance received a judgement against me for a PDL in Febuary.
I sent them the court Financial Disclosure to show EXEMPT(they say they never got the form).
Check Advance sent a SUMMONS and COMPLAINT for NON-EARNINGS to the company I have been contracted with **INDEPENDENT CONTRACTOR**.
This company did not answer the court BUT INSTEAD they misread the paperwork and thought they were LEGALLY ORDERED to pay.
They PAID Check Advance my ENTIRE check the following Saturday and were gonna pay the entire $1225.50 over the course of my next 3 weekly checks(total of 4 payments to CheckAdvance). The next 3 checks were NOT SENT, I was able to stop them.
The effects of not receiving 1 ENTIRE CHECK I am still trying to take care of
Are they LEGALLY able to do this???

Well that would depend on what state you are in. The laws are different in each state. Some one will be along shortly to expain that to you
