I've read the thread regarding this issue, and i get the jist of it, but its been a few years and just want to make sure everything stated in this thread still holds true. I had a online pdl (i believe through cashnet usa) at least 3-4 years ago (I live in PA) I'm receiving calls from someone saying he's been trying to serve me papers and that this is his third and final attempt at delivering these "certified documents" on behalf of his client, and that if I don't contact them and unless he hears from them otherwise I'm going to be considered "failure to sign" and he'll take the next steps necessary. Can a warrant be issued for my arrest due to this? I know a lot has changed over the last few years. He calls me at work and is very threatening. He said he'd be by my house or place of employment between 3 and 5 pm today to serve these certified papers and at that time i need photo identification.
Ok, so I've been doing a LOT of reading regarding the information on this site and i tell you what. I'm so glad I found this place. So here's another question I have. I currently have a payday loan out with Plain Green Loans. This is my second loan through them, and I live in PA.
The first loan I took from them was for 800$. I just did the math and it appears that I paid a total of $2480.58 for the life of the loan!!! My current loan out is for 900.00, and I just made my first payment today in the amount of $117.78.
Can I use this information found here http://www.debtconsolidationcare.com/paydayloan/dealingwith-illegallenders.html in PA to attempt to obtain a refund/have my entitled refund applied to my second loan AND recoup what I shouldn't have paid them in the first place!??? I can't believe i've gotten sucked into another one of these! Any help is great!

Hmm. CashNetUSA is a legal lender.
I'm betting your loan was through Cashnet, which is not.
Either way, these collection tactics ARE illegal.

Should I attempt to return a phone call to see the exact name of the creditor, if he is even willing to give it to me? I received a phone number of 855-376-7125. when I google the number I see people listing this guy as using these same tactics.

PDL's are ILLEGAL in the following states...
AR, AZ, CT, GA, ME, MD, MA, NJ, NY, NC, PA, VT AND DC
OH AND NH have very restrictive low cost interest rate laws.

They appear to be a tribal lender... not sure what that means or if that has any bearing, and they have a certification in the "about us" section of the site that says license number "001" and that they are licensed by some indian reservation... If I have any chance to get myself out of this jam with the 2000+ dollars i've already paid them I'm certainly going to do it...

Yes you can. However, what you have with PG is an installment loan, not a pdl. It's illegal because it's a tribal loan.

So it would be safe to tell them that even though they are not governed by state or federal law that "Tribal Loans" are still illegal in Pennsylvania?
I'm haggling right now about my account. They have agreed to only make me pay the principle back, (which is odd, if its legal and the loan contract is governed by the tribe laws, why wouldn't they say tough, pay it as the contract states?) but made no mention of a refund for my loan I just finished paying.
Any insight?
