Phone calls...how did you stop them?

Hi All,

I'm a little worried about phone calls to my employer,references and at home. I have sent a letter requesting they do NOT do this...but I know they will.

Were all of you successful in getting them to stop and communicate in email/letter? And if so, how did you do it?

Some will listen to a c& D letter, but others will not.

i just filed letters.DV and C&D if it is a CA.just C&D if it is an original creditor.they have to obey a don't call work order.even if it is an original creditor you can take action if they call your work after receiving the C&D letter.send all letters certified mail return receipt requested.

Call their processors and let them know that you have done so. They won't be happy.

Any U.S. creditor MUST CEASE AND DESIST from calling you at your work after receiving a request not to do so. Be sure to put it in writing and be sure to send it via certified mail so you have proof of receipt. If they do not comply, then tell them "do you know that by calling me right now after I have asked you not to at my place of employment, you are violating the Fair Debt Collections practices Act"? They will aplogize and get off the phone real quick if they're smart. Two problem cases that arise are if if you are dealing with a company that is offshore or one that resides on an Indian Reservation (not to mention any names Very Happy Very Happy ). The offshore companies don't care about U.S. Law because they can avoid prosecution, and the People on the Reservation CLAIM their "law" is sovereign (this issue is playing out in the courts as we speak). But domestic creditors must comply with that.

The original creditor can still call you at home. I finally changed my land line and cell phone numbers (to private numbers of course) and it was well worth any inconvenience of informing people I want to be able to call me of the new numbers - one of the best decisions I ever made.

If they are illegal PDL's, all they can do is threaten you and try to scare you into giving them money. They won't sue you because they can't win. I have not had one creditor - leagal or illegal - continue to call me at work after I sent them a request in writing (well I did have one two years ago and an offshore scammer who still calls) If they are legal, then it's a different story. File complaints right away if they are illegal - BBB, AG, State Finance/Banking Division, FTC. That way they know you mean business and cannot be pushed around.

It's really frightening ar first, and I was scared out of my wits in the month of April. But about 95% or more of the stuff I thought would happen, never happened. You just have to be strong and if you need encouragement, adivece, support, that's what this community is here for - as a resource to you during these stressfula and confusing times.
