I just got off the phone with the Lady from Cash Express and she was *&^%@#. She said she would take $100 every other week until it was paid off...that I owed her a lot of money and she would swear out a warrant against me. Then I talked to another one and she said that it is against the law to write a check on a closed account and she had to have it in two payments of $165 apeice. Or what? I told her I would try hard to get that to her, but if I could not I would call her.
So I guess I am being threatened? The CE lady told me when I asked if they were memebers of CFSA , "Yes we are guarenteed our money, but I WILL swear out a warrant." Like what is she talking about? I called the one I was worried about and got the girl I do not like I said I would call later.
I am such a wimp.
Now...what if I cannot pay $100 every two weeks to these folk. I will have a couple stringing yet..you know that I cannot make an arrangement with yet because of this.

No...this was on my old account which is now closed that I wrote this and it is a storefront.
My bank cannot tell them when the account was closed can they? I mean they can just tell them it was a closed account.

Paul...you have me a bit confused. I did talk to them and told them the account had been closed? Yes the check was on a closed acccount, but it has recently been closed.

Just to be SURE and don't whip me too hard here Cannr for bein' paranoid...thought maybe it might be different in this state...I called the Sheriff's office and talked to the Magistrate (might be a learning experience to shae with other's, no?) and HE told me not to sweat it, yes if things progressed they might issue a warrant, but I should tell them if that is what they must do, do it. He said it is a *slap* and they will not arrest me. Then I go to Civil court if I do not pay it off in the mean time? He siad to be cool and offer them $20 or $30 a week, even.
So what advantage do they have to threaten me? I mean does it make them feel better. The CE woman said I owe her a lot of money, after all. I have paid them $120 a month religiously for years on this loan...oh...I forgot, I pay it off and rewrite every other week so it is a *new* loan? But let us just imgine...$60 x 12 mos.=$720 x 3 yrs....I cannot recall... is $2160 - $330....ah..$1830 profit for them?
Ergh.....

egypt, I'm certainly not going to whip you! LOL! I say anything to ease your mind, do it. Calling the sheriff set your mind at ease a little bit anyway. That's all good! Let me just tell you "why" they threaten you - because you are attempting to get out of they cycle of paying and rewriting and paying and rewriting and paying those friggin fees every two weeks. This is BONUS money to them each month. The more people they have writing checks, the more money in their pocket. If they lose a good customer (and you did the math), they're out that amount of money just from ONE person (you). Also, by making payments, they're not getting their "full amount" (and another rewrite), so it's less money in their pocket at the end of the month. What it boils down to is BONUS MONEY for the storefront managers each month. This is why they try to force people to rewrite. Now, we already knew that CRIMINAL action is prohibited in your state. That's why I was saying don't stress yourself over it too much. I know you're going to anyway; however, it'll work out. Like the sheriff told you, if they feel as though they must "swear out a warrent" (which the wording just doesn't jive here), then tell them to do what they gotta do. Whatever gives them a thrill. The most that will happen is you go to civil court. Not criminal court. No, you did not write a "bad check on a closed account". No. It's posted in every legal storefront in the states where criminal prosecution is prohibited that is it not considered a "bad check" when entering into an agreement with them. It is posted on their wall. It has to be by law. What I can't quite understand is why the hell the ones that are members of the CFSA are giving you such a hard way to go. They should not. And, actually, I would file a complaint with the CFSA against them, as they are not following the guidelines that they are supposed to. I honestly can not, for the life of me, figure out why they are being so retarded about all of this. Hell, when they turned my checks in (because they said they had to turn them in to the bank), they came back "account closed". I was a little worried, but not a whole lot. And what did they do? They set up payment arrangements with me. Period. Yes, I was turned over to corporate on a couple of them; however, I just made payments to them. I made payments to one storefront who just held my check and I went in and paid. And one I had was a member of the CFSA and I just went in and invoked the EPP and paid them off. Yes, they tried to force me to pay and rewrite - wouldn't do it. So, they turned me over. Fine. It worked out better because I didn't have to deal with the a$$hole storefront managers. Why they want "two payments" is beyond me. Well, then again, it goes back to the whole "bonus money" issue, I guess. egypt, the worst that can happen (and it may not) is you would have to show up in civil court. Okay, fine. You will then make payment arrangements. So, that's why it KILLS me that storefronts pull this kind of crap. Pay these guys whatever you can. Like the sheriff said, if it's $20 or $30, so be it. You're making an honest attempt. Keep records of every payment. Keep records of every conversation these idiots have with you (their threats). Just in case you do end up in civil court, you will have some documentation to take with you. If you can't pay these people the amounts they are asking, take what you can. If they refuse your payment, fine, leave and make note of it. Cover your butt. Now, they might be just trying to scare money out of you. They like to do that. It may never go to civil court. It might just end up being these guys turning you over to collections. It could all be just a scare tactic. Whatever. Just do what you can, your sheriff gave you good advice, keep documentation, and just be prepared for the worst (which is only civil court). You will not be arrested and charged with "bad check". Nope. Not in your state. You do know that I am just STEAMING here at how your storefronts are treating you. I wish I was near you. I'd LOVE to go to the storefront with you.

Well, I cannot seem to log in but it is me....Cannr, I would love to have you go with me. If these people are not cool I may not be either, such as reporting them.
I have had two places actually three that have not thrown a fit...one I have not paid as they said they would send the checks through I am going to have to call them, However I paid them 120 a month for maybe 10 years? I would be surprised if they had the courage to tell me how much I owe them. And they are a small place, not CFSA?
BUT on the bright side...the one that is /was $460 is now....ta da...$115? In just a few weeks...one more payment and they are history.

I do not know either why some of these guys are so retarded. I mean why fight me over the amount that I am going to be paying them each week? As long as they get their money in a reasonable time. And they are mad...that just kills me too.
At this point, I really do not care.

Okay...here is where I stand today..no time to log in...almost have to go to work. I did not meet with the woman from CIC...I will just tell her to either set up those payments as is, send the check through, but that I will not rewrite on a closed account. Another person I told I was going to set up payments on the next check as we reviewed their policy...again...it will buy me some time to pay the others off. Two are not even aware that I will be defaulting, although I have. I still spent $120 with those I am not ready to do anything with YET.
Dang...I must be the one dumbest woman in the world...but I am getting smarter thanks to you all. I am sure I will be crying as they squeeze the last money they will get out of me come Hell or high water.
I did send off an e-mail to the man I know who works for Dave Ramsey and he confirmed everything we have talked about here, but because I know him so well I told him I was asking for advise for a friend? At that, I do not think he is as adept at handling this type of debt as those on this Forum. But he stressed to communicate with these folk just like Cannr says to do.
I have done all I can do for today...sigh::::

egypt, you are doing fine! You're doing everything that you're supposed to be doing. No. You will NOT rewrite on a closed account, and if they ask you to do that tell them "That would be breaking the law, correct?" and watch their jaws drop! You are NOT the dumbest woman in the world! Hell, if you are, then I am right there with you! LOL! You did good today! At least each day you are making SOME sort of progress. Even if it's just arguing with these idiots! You are honestly doing everything in your power and being an honest person trying to pay these people off. What they want to do is entirely up to them. They are being hard a$$e$ though. Keep plugging along, egypt. Something is bound to fall into place soon. Lord knows you're giving it your all. And I applaude you for it!

Thanks Cannr...I found that I woke up today, very impatient as the firt thing on my mind was who will call today? Then I wondered what I would do and how I would spend my time when I was not constantly worried about debt?
I do not know what it will take or how much time and anxiety I will be going through, but I do know that I am getting out from under this plaque.
I spend time reading in other sections how people have gottne out and I want to be one of the success stories...then I ask how can I possibly get through it? Flip/flop?
