I received an email from one these companies today. They've changed the way they do business since the new laws concerning the interest rates they can charge the military. They are licensed in Delaware, and stated a whole bunch of Supreme Court cases that they say proves that states can't control commerce between state lines, etc etc.

They did agree, although it's a different amount, to give me a refund. It's a little over 2 grand. Here's the catch, they want my new account number, routing number, etc etc.

I really really want this refund. I'm afraid if I ask them for a check, western union, etc, they won't go for it. But I'm even more afraid to give them my new information.

I do have a savings account with 5 bucks in it at a different bank. I had a car loan with them, and they made me open up a savings account with them when I got the loan. Should I use this account? I don't have any deposits going to it, so the worst thing they could do is to take my 5 bucks out. They don't have authorization to debit the account.

Or should I just give them my new account number? What about my savings account at that bank? If I gave them that number, could they somehow get money from my checking account? The numbers are different, but only slightly.

What should I do??? I really want this refund!!!

Oh, they also said that they insist on confidentiality, that way they aren't admitting to wrong doing.

NO NO NO don't give them ANY bank info. where a used/occupied account is concerned.

I would give them the one with the $5 in it just to see what they do.

My bank has a permanent freeze on ANYTHING where UCL (who I'm dealing with) is concerned....and my bank is great so I trust them not to let any sneaky debits slip through.

Yeah, thats what I'm thinking. The only problem with the other bank is I don't know the savings account number! I really want to fax the letter back tonight, but I guess I'll have to wait until tomorrow. I'll call the bank, get the savings account number and see what happens.

Did you get this in writing? I would be very leery on giving out any account info. It wouldn't hurt to ask for a check. See what they have to say. Tell them you currently do not have an account at a bank. And if they want they can send you a money order or something. It's worth a try.

Congrats on the refund though!! That is a good amount and I would want that refund also lol.

Do not under any circumstances give them your new account information, that would just give them a way to get into that account whenever they wanted to. Puddlejmpr that is a good idea get everything in writing.

puddlejmpr, just curious, are you in the Coast Guard? Sorry, not trying to offend you!

I received it via email. I want to ask them if they'll send funds another way, but I'm afraid they'll say no and cancel the refund. I need to think of something before I lose this refund!

Actually puddlejmpr, the amount that they technicially owe me is well over 4500, so they're getting off easy here. But I shouldn't complain, any refund is better than no refund.

Yeah, I hear you. When you say get it in writing, does email count? It is one of their email addresses, so they couldn't deny sending it. I really want this refund, don't want to blow this chance, but I don't want them to take anymore money from me. They want this kept confidential, or else I'd tell you the company that I'm dealing with here. Of course, I wouldn't mind telling you who I'm dealing with, but again, I don't want to blow my chances at a refund.

Hey Sub, not offended. No I am not in the coast guard sorry. Do they know that you have some sort of bank account? And save those e-mails. If you have been working with anybody on getting this company I would forward those e-mails to them also. I always forward all my e-mail to my state DFI. This way she stays informed and I have proof besides my own copies. If they don't know that you have a bank account anywhere right now then it wouldn't hurt to ask them if they would be able to send the refund to you in a different form of payment. And if they can do this then you will keep quiet about their company.

No, they don't know about any bank accounts. At least not to my knowledge.
I'm going to call my bank tomorrow. I'm going to ask them what can I do about this. They're a local credit union, I've been a member for a long time and they all know me. It was one of the easiest things I've ever done (closing my account) because they were so helpful and friendly to deal with. I'm sure they can help me out. When I first changed my account, my direct deposit was sent to my old account. They had to manually transfer it to my new account. Maybe they can do that? Who knows, but I've gotta figure this out.

lol @ squids Laughing sorry Embarassed I got the nickname puddlejmpr because when I got my first car it was small and people said it had to jump over the puddles in the road or it would drown Embarassed

But anyway, If you feel ok with giving them that account number and you know they will watch over any transactions and you will not get any fees if this company trys to start anything, then ok. But for me I would be kind of worried about giving them any account info because of what they have done in the past. But that is your choice. I know you don't want to lose the refund and you feel that you need to go with what they want in order to get it. Good luck on this and please update us. Ok I guess I am just nosy lol I hope and I will cross everything I have that they don't screw you over again. Let us know if they really do as they say their going to.

Hey sub...what if you told them flat out tell them tht you dont have any checking/savings account or anything? That isnt a contingency of the refund is it?...that you have to give them your account info?

Puddle, sounds like my first car. At least I didn't have to pay for it. Keep EVERYTHING crossed! Hahaha. I guess I just need to be patient. Thats the problem with my hours. Since we got home from sea, I'm working in a Communications Center. I work 12 hour shifts, 2 weeks of days, 2 weeks of nights, etc etc. I'm on the night schedule this period. It sucks sitting here for 12 hours trying to get things done when nothing is open! Tomorrow is Thursday, and I'm thinking that if I don't get this done, the refund won't come until next week, etc etc. I just need to slow down, catch my breath and do the right thing. I'll call my bank tomorrow, my other bank (with the small savings account) and try to figure this out.

I definitely will keep everyone updated.

Hi Volley, how are you? Not sure what would happen. In the email it says "I will authorize you to receive $2,005.94 by electronic funds transfer directly into your bank account." And, If this resolution is acceptable, please sign the acceptance statement appearing below and fax it to xxx-xxx-xxxx and I will forward your refund. Be sure to include your bank’s name, account number, account type and ABA Routing number".

They didn't give me any other options. Number one, they want to keep this between me and them, so in order to get a refund I'll agree to that. Number two,
I'm afraid if I respond in any way other than agreeing to their terms, they'll refuse any other offers.

I really don't know what to do here. I guess I'll just have to wait until my banks open and see what they say.
Does anyone know, if this place has my savings account number, can they then make debits from my checking account? When I changed my account, I didn't touch my savings account, I only changed my checking account. It seems to me that if they were going to try to link the accounts, wouldn't they have done that already??

Sounds like you have a good head on your shoulders now. I wish you luck with the bank tomorrow and hope you get things straight so they can send you your money.

I am thinking that it is going to be hard for me to work tomorrow night with EVERYTHING crossed, but I will try Laughing oh and I know how it sucks working nights. But at least mine are not 12 hours shifts, yuck.
