Once again I have gotten myself in a financial bind. Has anyone ever bounced a check thru telecheck? I bounced a check that Telecheck is trying to collect on. I am afraid of going to jail!! Someone has been calling from investigations, which is an office within telecheck. I made a partial payment on this check. Will they prosecute me?

No you won't go to jail. Just keep in touch with them and tell them you will make good on the check and keep your word. To go to jail they would have to press criminal charges. For what? You did not commit fraud. Fraud is a deliberate act. Also, if you were in jail they could not collect your money. Debtors prison went out 200 years ago.

Thank you frogpatch! I have been avoiding their call when I see the number on caller ID. I haven't been able to keep my word and the payments have been smaller than what we agreed upon. Guess I need to bite the bullet and call them. I tried to get a loan thru Cash Call and got turned down which after reading postings on this site about that company, I am better off!

You are much better off, without a loan from Cash call. That would have been a nightmare.

Just bit the bullet like you said and call them. They will be more than happy to help you work out an agreement. Avoiding their phone calls isn't going to solve anything and will make things worse in the end for you.

telecheck is for bounced checks. Legally speaking the person or business to whom the check was written can press charges for the bad check. But you don't go to jail for 1 bad check.

I guess that is why businesses use telecheck so they don't have to worry about collecting on returned checks. I am going to bite the bullet and call. I love this forum and I just hope I can be of help to someone as well!

Until I get this cleared up, I will not be able to write checks at any business that uses telecheck What a mess!

Yep, that is correct. You can use a debit card, if you have one.

I have a question. You can't go to jail for one bad check? I had a friend (this was quite a few years ago) who was arrested and held in jail for a "bad check". This person was never contacted by the store (it was a grocery store) regarding the check coming back bounced. Next thing you know, my friend had a police office with a warrant at the door. Went to jail for "theft by deception". She had to pay it (wasn't even aware of it!), pay court costs, and also shows on her "criminal record". That was for one bad check.

For one bad check? you sure about that? In some places,yes, a bench warrant can be issued for repeated bad checks.

If you write a bad check and don't take care of it, eventually they will take you to court. If the check is over a certain amount (whatever it is in your state)it could be a felony and if you don't make an effort to pay I think they could arrest you. Please don't dodge calls from telecheck. Call them and be honest and make payment arrangements and stick with them.
