I just received a phone call from United Legal saying that Payday One Cash was going after me for a loan I took out in 2009. First off, I have NEVER taken out a payday loan with these people I am actually about to start the process of fighting illegal lenders but haven't even sent out a letter yet. Second, how in the world did they get my work number to place that I was not even working at in 2009 at the time the loan was supposedly taken out in. What in the world do I do?

If you've not taken the loan, then just send them a 'Cease and Desist' letter stating that the debt is not yours and ask them not to contact you for the debt anymore. Keep a copy of the letter with you for records.

The agencies like United Legal call random numbers and threaten people to suck out money from people. Don't pay them a penny. If they continue calling you for the same debt even after getting the cease and desist letter, you can file a complaint against them with the Attorney General of your state and the FTC.

By the way, tell this collection agency you will not discuss an alleged debt over the phone, and they are required by the FDCPA to send a letter of collection via the mail within 5 days of their first initial contact with you, also tell them if they continue to call you will be forced to file a complaint against them for not complying with the FDCPA (Fair Debt Collections Practices Act), which could subject them to a fine!

Yes I have taken out a payday loan. And have yet to default. I did some research on the internet and come to find out this supposed company basically gets your info once you apply for one on line and then starts calling saying that you have an outstanding payday loan to get you to send them money. They called my work three times today, have called my cell a couple of times etc. I refused to talk to them at work, and they got really rude with me and told me I was in a big legal mess etc. etc.. I called them when I got off work and told them I knew that they were lying and that they were trying to steal money from me because #1 I never took out a payday loan in March of last year, #2 Even if I had taken out a payday loan in March of last year it would be impossible for them to have my current employment information because I didn't start at my current job until November. and #3 The same goes for my phone number. I switched cell carriers and got a new number in July of last year. I know its a scam but it scared me for a second. After I told them all this they didn't seem to want to talk anymore. Amazing how that works.

It is scary for sure, please make sure you file a detailed complaint with the FTC, BBB and your AG.

I was wondering...I live in arkansas but took a payday loan out when I lived in tx...I am now getting calls from a place called Department of Checks Systems. I actually forgot about the loan i took. what do i do to find out who it was through and they say I owe 1100 and I know I did not take that much out. help thank you...I think the original loan was through maybd SMG not sure though...have not documentation on it
