They called today (Tim Atkins' assistant  )
They are planning on garnishing my wages which they say is completely legal in my state (KY). He also said that I'm an idiot and I'm about to experience a really big problem.

How can an illegal pdl go to court and get a court order to sue you. They are known to sat these stupid things. Please do not worry about this .

I try hard not to, but I get so upset when they call. I am willing to pay them back what's left of the principal amount, but they won't agree to anything less than $390 and they won't send me a letter stating anything about a settlement. I tried to be nice--that's all I can do.

It is unnerving, but you are now strong enough to kniow they are just telling yu a bunch of crap. Dont back down. Pay only what you are obligated to pay.

The only problem is that they won't accept what I owe as payment! They won't accept anything through the mail, either.

Do you have an address to send payment to. If so I guarantee that they will take it. After that tell them to go ahead and take you to court. They won"t. It is just plain hollow threats that they are delivering. Like Kash said, how can an illegal company take you to court for garnishment for money you don't owe in a state where they are not even located.

I don't have an address for them--the letter I sent to them revoking wage assignment and ACH was sent back--I ended up emailing them.

cdollar, just remember that in KY, internet plds are not considered collectable debt.

How can they file for a wage garnishment if the state does not recognize the debt and will not allow collection on the debt? They can not.
I also filed a complaint with the State of Utah in adddition to the KY AG. It was easy and can be faxed to them.

Most of them have the same address in Delaware. It is Mailboxes Etc. That way they can use the loose lending laws of Delaware. The Delaware Attorney General must be getting awfully sick of reciving complaints about PDLs that do not even have physical locations there.

Got another call today from a different guy, "Mr. Johnson". I let it go to voicemail, because I've alredy sent them the C&D and told them not to call me at work. He said he was from "First National", but the phone number is the same.
