They are correct that you need the ACH Dept. Is there a branch manager you can grab as a go between? I can give you lots of Electronic Funds Transfer Act info that will support your case. You just need to get to someone that cares about right or wrong. Can you grab an email address for the ACH Department or a physical address? I'd probably tell you to outline your case and send it certified. If you tell me what bank I may be able to find contact info. There are also options you could pursue through NACHA, just to get their attention. It's hard for me to say why they would or would not agree with your position of fraud. That would depend on the pdl contract. For example, if you agreed to withdrawals of $90 every second Friday and that is when and how much they debited, that would not be fraud. If the amount was unscheduled and/or a different amount that would not be fraud.
I know these answers are not clear but I'm hamstrung without details. Often times your own bank is just as bad.
I guess what I'd need to know is
1. When was a "Stop Payment" acknowledged if there was one?
2. What were the terms of the contract..if you tell me which pdl I can probably dig up their contract.
3. What are you trying to accomplish (have pdl fees returned, returned item fees, etc)
4. How close to 60 days are these transactions. After 60 days this fight will be virtually impossible.

mandywebb. . .I do just about all my banking on line. When I got to the internet site there is an email button that I can click on for help. That is how I got in touch with the ACH department of my bank. They called me right back and that was how I got the info I needed to set the wheels in motion. I must tell you, I bank with a small hometown bank and they are very acommodating. Not like the biggies who have thousands of customers. Can you call your bank and just ask for the ACH department?

I have called the ACH department and they only have a voicemail that comes on. They are also only opened till 5 pm. I called another department once and they said I needed the ACH department and they could not help me. They also throw in there that they close at 5pm and that was 3 hours ago call back. Very rude people!!!

Hi angell. I'm not putting it back up. The information was too in depth. The site had an analytics package built into it that showed a great deal of pdl activity. Too much so for the level of detail I had posted. Feel free to ask anything, however. I'll do my best. There may be a new, more general, site coming in the near future. But thanks for asking.

James...the bank manager is no help and has no clue what to do. I bank with Charterone. I had tried to stop payment back in Dec. but did not go through the bank I tried through pdls. I found this site in late Feb. and that is when I went to the bank and they refused to close it and said I had to fill out the fraud forms. I could only go back to Jan. because that was sixty days. They filled out three and then the manager stopped and said I had to come back in for more questions. The three were credited back to my account. They were from early Jan. then the rest of the forms were done filled out by a teller because the manager was not there. They did not give me any credit for them because they said it was after they had been posted. I think the teller filled out the forms incorrect. So the process was started within the 60 days. I am trying to find out why my first three were fraud and not the rest. I can get no answers. I am seeking the fees that pdls charged and the charges from the bank.

Would you be willing to sue the bank in small claims court over it? It won't over get to court, but you'll get your money. The Electronic Funds Transfer Act covers all of these issues in your favor. Google electronic funds transfer act and you'll find it. It's not too bad. I'm afraid the answer to your question is "because they can"...not to be sarcastic.
