This department has received recent communication regarding the above account. Please be reminded that the terms and conditions of the agreement you entered into with our company was presented to you at the time of your application and you were given 48 hour window in which to cancel the agreement. In addition before each debit processed ( within the guidelines of the agreement ) you were given an account summery stating your options of fulfiling the agreement including instructions for repayment of the entire amount of the advance, in order not to incur additional fees. Since there is no mention of a specific problem with the way your account has been handled we must conclude your account was handled as agreed therefore your account will continue to be handled as agreed. Your persistence in this matter with us or or any other agency that does not include an account of how your account was handled out of the guidlines of the signed agreement will merit the same response as the one you are now reading. Please also note, we are the original creditor, the FDCPA applies only to 3rd party collectors.

They are correct in the fact that the FDCPA applies only to third party collectors.
How much did you borrow from them and how much have you paid them so far? They seem relatively docile compared to some. They are acting professionally so far. Not to stick up for them.

if I may ask, what did your letter say? did you offer to repay in payments?

Another question... what state do you live in and how much have you paid back to them on the PDL?

I live in California. Yes i offered a payment plan. I borrowed 350.00 and have paid 105.00. The letter I sent them revoked authorization to debit my bank account, what California state laws are for payday loans and what i legally owe them and a payment plan and that i filed a complaint. So if anyone knows what to do next please let me know.

Wait for their reply. If you don't here back in a week then contact them again to see if you can get feedback. Since you have insulated your bank account from them, you should be okay to wait until you here from them. My guess is that they will try and get to you pay more over a shorter time frame than you proposed, if they do, just restate your offer.

Mention the laws again in your letter along with the copy you sent last time. They have sent you a generic letter. Request for someone to review your account personally and give you the response.

United Cash loans is affiliated with Rio Resources. I won’t be worried about them because there are too many negative complaints in this forum.

I would also make sure that they are totally blocked from your accounts. Sometimes these companies will try and debit in smaller and larger amounts to get past the block. It can be an even bigger pain to deal with. I will check the Dept of Corporations website to see if United Cash Loans are one of the ones banned in California and will BRB.

OK, United Cash Loans is not licensed to do business in California as per the Dept of Corporations website. I thought they might have been one of the ones banned by Arnold last September, but no records of any Cease and Desist orders against them. Even so, they are unlicensed.

I would write them a letter validating the debt and ask that they show that you owe the debt. If you really had owed that, they never should have let you reloan with them after the fact.

PostPosted: Wed Jun 13, 2007 6:30 pm Subject: PAYDAY LOANS

I borrowed $300.00 from a loan company and they deducted over 350.00 so far from my account and none of it even went toward the loan itself, now they are saying that I owe them $780.00 and that they are going to have me arrested at my job. They continue to call and harrass me at work saying that they are going to call my boss and then one rep. asked me if I
use my mouth to kiss my husband at night I think this is total harrassment. I explained I have been off for
a couple of months under workmen's comp.and that I could later pay off but they are so rude. I closed my accounts. I live in California and the loan is from Florida. Please inform me what should I do.
