How do you respond when they say they are legal?

Coming from the AIP thread and some of you saying that AIP was quick to mark you paid or even give a refund. I have not been that lucky. They want payment in full. I too had a gal who actually told me to go look at the BBB. I informed her they had an unsatisfactory rating. I have paid $356 on a $200 loan. When I tell these people they are not opporating legally in the state of KS they say they are licensed in whatever state they are in and only storefronts have to work under those state laws. They work under the laws of their state and don't have to follow my state's because it was done on the internet. I have to talk to Instant Loans Now and AIP again today. I have paid the princ and then some on those two. I also have to talk to payday2go. I have only paid them $50 on a $100 loan.

Good morning,
I am from pa and payday loans are forbidden in this state, however they have lent to me under other state laws. When I contacted the department of banking here in pa they told me that it is a loophole in the law that these payday lenders use. Crazy as it sounds, that is how they get away with it.

Have you talked to your attorney generals office? I will bet they could answer a lot of your questions and if not, point you in the right direction for that. Most of the times they have to abide by the laws of the state they are lending in. As fedup said, there are a few states that have a loopehole. I would suggest talking to your AG and see what they have to say. They may have you file a complaint with them and you can also file a complaint with the BBB on these people. Do not let these people intimiate you. Most of the internet payday loan places are not operating legally anyway.

Please file your complaints. I, for one, got my account with AIP resolved through the BBB alone. They refunded me the total amount I overpaid above the principle amount. Instead of trying to deal with these people, who will keep insisting you still owe $800 when you've already overpaid, please file your complaints. You may be surprised and get it resolved through the BBB alone. Although, you need to file the complaints with all the agencies.

Did you file your complaint first? Then does the BBB contact them about it or did you just call and tell them you filed a complaint?

Ask the PDL operator which set of state laws will apply when they sue you for the money. In case the operator is an idiot the answer is your state laws not the state or county or country they are licensed and based out of since they have to sue in your state and county. Tell the operator the loan was done on the internet to you in your state so you do not have to operate under their state laws. See how this argument works both ways. That should be enough to establish that you are only subject to your state laws plus any federal laws. These companies will not sue you anyway because it is too expensive for them and they will lose. They do not report to the credit reporting agencies either typically so there is no penalty to you for not paying them. I would just pay them what you owe according to your state laws and then tell them not to contact you anymore unless they do it by filing a civil suit.

When I dealt with the BBB regarding AIP, I filed my complaint after getting NOWHERE dealing with AIP. They contacted AIP on my behalf. AIP then went and "took care of the problem" and THEN they responded to the BBB that it had been taken care of. It was a total surprise to me! So, file with the BBB and they'll more than likely settle it, then respond to the BBB with the outcome. It will more than likely be good. However, I had also filed with the AG and the FTC. But the BBB was able to resolve it quickly.

I just talked to Jackie. Somebody on here at suggested her. I told them I was talking to the BBB. She is getting with my account rep and they are supposed to call me back. We shall see. I'm hoping ofr PIF!!! icon_biggrin.gif

YAHOO!! After talked to Jackie and a supervisor in collections I was able to get the account PIF. This is actually the first one I have that kind of luck with. Some I just pd the principle with no finance charge (this time) others are being sticklers. At least I won with one. THANK YOU for all your help!
