Here is a copy of the email I just received from USFastCash. Below it is my response.

This department has received recent communication regarding the above account. The communication received is recognized as portions of a form letter (cut and Paste template) currently being widely circulated via the Internet. Unfortunately this form letter is filled with misleading and incorrect information. The use of this form letter leads us to believe that there is not a specific complaint connected with the handling of your account. Please be reminded that the terms and conditions of the agreement you entered into with our company was presented to you at the time of your application and you were given a 48 hour window in which to cancel the agreement. In addition before each debit processed (within the guidelines of the agreement) you were given an account summary stating your options of fulfilling the agreement including instructions for repayment of the entire amount of the advance, in order not to incur additional fees. Since there is no mention of a specific problem with the way your account has been handled we must conclude your account was handled as agreed therefore your account will continue to be handled as agreed. Your persistence in this matter with us or any other agency that does not include an account of how your account was handled out of the guidelines of the signed agreement will merit the same response as the one you are now reading.

A copy of your electronically signed contract can be faxed for your review. If, after your review, you find your account was handled differently than was/and is stated in the agreement please forward those details at once so further review of your account can be completed. It is our earnest endeavor to provide the best possible customer service and customer satisfaction and miss-handled accounts will be researched and addressed immediately. Any Legal questions will not be answered; they must be placed in writing to our Legal Dept via Fax1-800-470-6614.

Please also note, we are the original creditor, the fdcpa applies only to 3rd party collectors.

Thank you for your response.

Regardless of the origin of the context of my letter, whether it be from the internet, a consumer reporting agency or Florida's Financial Regulations Department, the matter still stands. USFastCash IS NOT LICENSED IN THE STATE OF FLORIDA. As per Florida's Attorney General, USFastCash is also in violation of Florida statutes pertaining to pay day loans in this state.

My specific "concern" is that you are an illegal online lending organization, without licensure in the state of Florida. Therefore, you are breaking the law by continuing to loan money to consumers in this state, including myself. Additionally, your interest rates, fees and other wide and sundry charges are in excess of Florida statues pertaining to interest rate caps and usury laws. So, there you have your reason for "my persistence in this matter."

Please be assured that I do not have ANY legal questions. They have all been answered by my State Attorney's Office and, my complaint is being investigated. This is not a "cut and paste" statement but a statement of actuality and fact. I filed a complaint, have spoken to their office on numerous occasions and know exactly where I stand legally.

My bank will not honor any future debits and have been advised of the situation. I have rescinded your right to contact my employer, friends, family or references and I have also withdrawn any wage assignment that I may have signed pertaining this loan. However, if you feel the need to not comply with any of the above, please be advised that all phone calls will be recorded, all wage assignments will be denied (my payroll department has also been advised,) and any attempts at the above mentioned actions will only serve as additional documentation against USFast Cash.

As for any contract I may have "signed" over the internet, by all means please be so kind as to MAIL IT VIA U.S. POSTAL SERVICE to the address I provided: XXXXX. Any legitimate organization's legal department, online or otherwise, would not find this request unreasonable and would also be capable of receiving certified correspondence at their mailing address. So, once again, please be so kind as to mail a copy of my contract. It will serve as additional evidence and, as per the Attorney Generals Office's request, will be immediately forwarded to them to aid in their investigation.

It you would also be most helpful if you would provide me with your audit number for the State of Florida. This request is also reasonable and within my rights as a consumer.

Their e-mail response sounds like a cut and paste template they have sent to consumers. I've read it many times around the boards Rolling Eyes These clowns crack me up. Your response sounds awesome! I loved it and you should stick it to them. You have the law on your side and they don't. You've done the right thing by filing complaints against them and keeping in contact with your AG. I know the Florida AG does a great job when it comes to this stuff. It will be interesting to see if they respond to you. They usually duck and hide when the tough get going. Watch out because they also lie to government agencies. Mad

No, I haven't. I have one payment left which I have offered to pay via U.S. mail (along with interest rate as per the state,) but they did not respond to my repeated requests. That's when I began to suspect something wasn't right. So, I closed my bank account, contacted the AG and received the email from them you just read. At worst, they can accuse me of being in default and send me to collections. At which time, I will make my last payment. However, after being on this forum, I've also learned how to deal with the collection agencies these sharks use!

Yeah, that's the same letter a bunch of pdl's all send out! Seriously, they are the ones using a cut and paste template! This is becoming the norm for the first repsonse back from a payday loan company that doesn't think they need to follow the laws . . . . Funny . . . .

Know too that in most states collection agencies also have to be licensed with your states DFI before they can collect from consumers . . . . .

Good for you, Shey! Stick to your guns on this because they are just bullies. I dealt with US Fast Cash myself so I know what clowns they can be. They sent me to their "inside" collections department. They just sent me a bunch of e-mails stating to pay through their website. I never send them a red cent because US Fast Cash owes me money. Then a few months later, they sent me to outside collection agency based out of Texas. I was not schocked when they didn't validate my debt. I never heard from them again. They have been quiet for a long time but they love to crawl out of the rock they live under. collection agencies don't have to be licensed in my state. They just have to follow the fdcpa. Keep us updated on your progress Smile

This letter is the EXACT FORM LETTER I got from $500FastCash Yesterday with the same wording. HILARIOUS! I am not worrying one iota about them, they can call me, I don't have to answer! To Hexx with them!

Interesting! The same EXACT letter? Don't these people know that just as they "circle the wagons" when forced to account for themselves, we consumers can do the same when it comes to defending ourselves? Knowledge is definitely power! If USFastCash sends this to an outside collection agency, they will be receiving a debt validation Letter via certified mail. I only hope they stay in one physical address long enough to receive it! LOL...

The exact same letter . . . . If you have some time to read through some threads on this forum you will see this same letter posted at least 50 times, from different companies. It's the standard denial response!

Well, Morning, United is the last of my three pdl nightmares so I guess I'll be receiving the same letter from them as well. Is there a connection between United and USFastCash?

Shey,

They are both DBA's of MTE Financial or Rio Resources. Right now they are located on an Indian Reservation in Oklahoma to try to skirt the laws. They are not licensed in any state from what I can tell.

yes usfastcash are clowns. when they started the deluge of calls they tried to claim it as a nsf check
when i bought up the laws regarding illinois lending
they call me a liar. they are a joke. keep up the
fight and remember as i have,in my state these loans
are illegal, and should be treated as such.
