I defaulted with VC Funding almost a year now. I thought they had gone away and this morning I received a voicemail from a lady named Kelly verifying employment on me. Does anyone know if they send wage assignments? I can't afford another wage assignment letter coming to my job cause my job will honor it. Please advise me thanks.

Is VC Funding a pdl? Did you revoke a wage assignment with them once?

yes they are a pdl and back last year when I defaulted with them I sent them a letter revoking wage assignment. The thing is that my employer does not care and if they reveive another one they will garnish my wages again cause they did it with Sonic Payday.

Did they have a court order to garnish your wages? A garnishment is different than a wage assigment. A garnishment can only occur if there is a court order, a wage assigment can only take place if you do not revoke it. A wage assignment is an option, if you revoke it, then your employer MUST honor that. Does anyone else have any insight on this, am I correct or not? Confused

you are correct, specially here in Florida garnishments have to be thru court orders, but the witch in HR did not want to hear me at all and I argued and fought with her gave her a copy of the letter revoking it and she argued back and said you owe the money and I will garnish your check. If it gets to the point where it happens again I will definitely take this to the labor dept. I just want to avoid it from happening again.
