OHIO PDL TROUBLES

I've had a thread before ---- but I've tried doing a few things with my PDL's before I posted anything else.

I have several questions --- but let me refresh my scenario.

I live in Ohio. I have the following PDL's which are all either defaulted or on EPPs except for one online PDL.

Storefront:
Check Into Cash 912.50(EPP - 1`st Pmt July 2008)
Check N Go 912.50 (EPP - 1st Pmt July 2008)
Quik Cash 575.00 (EPP - 1st Pmt 8/15/2008)
Cashland 912.50(Defaulted - 1st Pmt to begin 8/30)
Purpose Money 912.50(Defaulted - don't know how I'm going to pay)

Internet:
BIG Int'l $200 + Fee (Defaulted)
ACH Loan - $200 + Fee (Defaulted)
Quickets Cash Adv (MTE) $300 + fee (defaulted)
Magnum Cash Adv ($387 -- will take payments until I can get them paid in full in October - defaulted)
World Wide Cash - $200 paid $89 fee (Haven't defaulted on this one yet)

I'm doing my best to get all the storefront loans paid.

What can the internet payday lenders legally do to me for defaulting?

My Credit Cards and loans are now falling 1 month behind -- but I just don't have the $ to pay all of them. I really don't want a judgement against my wages --- because my employer has a clause that employeers shall not have any garnishments of wages (other than child support) in their handbook rules ---- or they could face termination.

How much have you actually paid back these Internet lenders? ACHloan is illegal and unlicensed, they are located in Ireland, if you have paid them the principal amount, you are done with them. BIG is also unlicensed and illegal. You need to send these ipdl's a wage revocation letter and get your account closed asap, as long as you have worked out arrangements with your store front lenders and you follow through with them, it should be safe to close your account and reopen a new one at another bank. I am going to be posting your laws shortly. You need to focus on the store front lenders and get them paid off, then you can work on your Internet lenders.

You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.

What should you do?
Close your account asap, if you are unable to close your account, go into your bank and ask to speak with the Branch Manager, tell him/her you need a hard debit block placed on your account immediately! Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. This is your privilege, do not accept no for an answer. The following link will provide you important information regarding closing accounts. CLICK HERE

What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. Smile

I searched THIS data base and could not find a license for any of your Internet pdl's, this means they are unlicensed to lend to Ohio residents. Please make sure that you follow through on complaints against these companies at the following references in the above post. Smile

Do you know anything about the other internet loans? I am just worried about the internet lenders sueing me before I can get them paid. The only internet loan that I have paid on so far is the Magnum Cash advance --- they are willing to work with me as I stated.

My account has been closed that all these are drawn on ---- of course from being overdrawn so I also owe the bank $$$. Luckily I have another account.

I have every intent in paying them what is due ---- I just feel like I am going to suffacate between now and mid-October because I'm afraid I won't even have gas $. I've been looking for a 2nd job --- but can't find anything to accommodate me not getting off work from my job until 5:00 pm

Yes, I already checked them out. Just follow my instructions with the Internet lenders and you will be fine. If I were you, I would take care of the legal ones first, then you can start working on the illegal ones, just make sure you get the wage assignment revocation letter sent to them all so there will be no chance of having you wages attached, also show your employer a copy of the revocation letter in case any of these companies decide to attempt a wage assigment. I think they should just be illegal period! Especially the way they are allowed to prosecute you.


Any how --- I am only obligated to pay the principal amount on the internet lenders correct? I had the Quickest Cash Advance (MTE Financial) say she can not set up arrangements through mail / email --- they do not accept money orders and I know that the amount she stated was 4x the original loan amount that was owed.

I just defaulted on all the internet lenders July 31st. I have only heard from 1 of them so far.

you have BIG and ACH loan? I was dealing with both of them too last year, you won't work anything out with them

Big and ACH are both off shore illegal lenders. If you ask them to validate the debt they will nit be able to. Forget about them doing anything to you, they can not. They should be the last ones you worry about.

I have had pdl yes report me to the credit bureuas, they sent my acct off three times, and each of the places sent it to the credit bureuas, i am in the process of getting them removed, i disputed all of them, and one has come off so far, just waiting on the rest!


From what I have heard they have to supply a contract or something. I not a hundred percent sure on how it works, but so far 1 has come off and the other 2 are still in investigation.

I will update you though as to what happens. Have you sent your letters off?

I'm not sure where you may have heard it was difficult to get pdl's off of your report but it's incorrect. At least in my case. Just make sure you keep all your paper work to submit to the CRA's. Also, I would venture to say that illegal pdl's would be easily disputed with a CRA, with you being in Ohio, none of your Internet lenders seem to be licensed. I couldn't find a license for any of them. Smile
