Took out a loan with cashnet usa. I could not pay and defaulted. They called my house and my wife answered and they set up payment arrangements with her. She was not authorized on the account. I told her that was not in our budget and how did they enter these with you? She called back and no one would speak with her saying she was not authorized on the account. I finally e-mailed them giving them permission to speak with her and that the payment arrangements entered into were not made by me and she was not authorized at the time and I need smaller payments. They will not do anything until the next scheduled payment goes through and I will be in trouble because I "so called" entered into payment arrangements and now defaulted on them. My wife has tried to speak to them and they will not even let her talk. They said they lost the phone call and that it must have been me, BUT IT WAS NOT. I have all times and days of phone calls.
Is this payment arrangement my wife entered into legal even though she was not authorized? How much trouble am I in now. I do wish to pay them but I just need smaller payments and how long before the bad stuff happens.
Live in pennsylvania. Should I stop payment on the debit?

I would close the account, and make sure to read the sticky about closing the account. You will need to protect it from ach transactions.
Cash Net USA shouldn't have spoken to your wife. They know that and are trying to backpedal.
I would close the account, and send all payments in by money order.

I was reading Nevada law which states 30 days to enter into payment agreement, 90 days for repayment of defaulted loans.
Does this 30 days start from the default or from when the loan was originally issued.
I have sent an e-mail requesting that all ACH/e-check authorizations be stopped on my account and that I will send in weekly money orders for 100.00 until paid in full. Waiting to hear from them, but can they still send ACH through if I request to stop?

Yes they can and they will keep debting your account when ever they want to. Your best bet is to close the account, if not they will try to take out the entire amount that you owe them which can lead to nsf charges from your bank that will pile up to the ceiling. Close the account and then if you want to set up payments contact them after you secure your money.

Went to the bank today and closed the account. Sent an e-mail stating the situation and that I would send them 150.00 per week by money order until paid in full. They will not accept this but that is all I can pay at this time or else I will not be able to pay mortgage and utilities. They said there is nothing else they can do for me and they will consider this a refusal to pay. Original loan was for 900.00, paid 68.95 and 68.95 so far.
They are saying that the agreement my wife entered into can not be changed, but from the first post you can see what happened.
I just have no idea what to do!!!!!
If my wife entered agreement without my authorization to speak to them how can this be legal. I have documentation of phone records, times calls were made here, but they did not even want to hear it. They stated they were looking for the phone call but there is a glitch in their system and they can not find it.

My credit union was very understanding to the situation and helped out alot. I am very thankful to them.

LHT I think your handling this well. Just make the payment as you can and on time every week. They won't like it but they should take. I'm not sure but I would think if anything the next thing they would do is turn it over to a collection company? And then they would make payments arrangements with you...

Cash Net can be a pain to get to agree to payments.
What many have done is this - Just send them the money order every week. They will still call you, but just tell them you've sent payment and hang up. With your money order, send them a letter stating what you are doing, and that's that. They will cash the money order.
