I have done extensive research myself on these debt settlement companies as well and have worked at a debt collection law firm and I can tell you I have spent may days explaining to people who they work and what a rip-off they are. If you dont believe me try "google"-ing "Hess-Kennedy"!!
Read and weep!! These are so-called "lawyers" working for debt ridden people who have been recently shut down for decieving the public and deceptive sales & ethic practices!!
Debtors have the ability on their own to take care of these problems and dont even know that they can. Also google
"debt settlement companies" and read the blogs!!
I think your minds will change quickly about most debt settlement companies.

I would like to be included in the class action lawsuit against
Mezey also. I have been trying for a couple of years now to
try and recover the $8000. they took from me. After taking
all that money they never paid a single debt. Now when I
call they put me on hold until I"m so upset I hang up. Or when
I get ahold of someone they tell me it's in my husbands name
and they'll only speak with him. Then he'll call and they'll tell
him it's in my name and they'll only speak with me. All they
do is take advantage of you in your time of need and make
the situation you're in worse.

you wrote..."The Bar Association said they had numerous complaints against Melendez for pretending to be a lawyer and were going to file suit against him with the AG's office, but said that the law firm was delivering as per their contract."
why is it when i called them(BBB) they have no record of any complaints....can you substantiate your claim or is this a personal vendetta...?

DSA is a debt settlement company, however, they often violate the Deceptive Trade Practices Act § 17.46,
“(b) (3) causing confusion or misunderstanding as to the source, sponsorship, approval, or certification by, another; (5) representing that good or services have sponsorship approval, characteristics, ingredients, uses, benefits, or quantities which they do not have or that a person has a sponsorship, approval status, affiliation, or connection which he does not; (24) failing to disclose information concerning goods or services which was known at the time of the transaction if such failure to disclose such information was intended to induce the consumer into a transaction into which the consumer would not have entered had the information been disclosed.”
By confusing consumers not only in Texas but nationwide to the fact that they are a debt settlement company and not a debt consolidation company. In addition, they proclaim all their employees are bonded and this is a blatant untruth. Furthermore, they state their debt negotiators are all certified, again, this is patently false. Often consumers are given advice regarding their credit scores when entering their debt settlement program and that advice again is false and misleading when DSA salesperson(s) tell consumers their credit score will be minimally impacted.
I can understand your frusteration with this company. How ever some companys, really do what they say, and say what they do. Their are some risks to debt settlement, and the risks differ from state to state.Nothing frustrates me more than one company giving the whole industry a black eye. It is important for anyone who is planning on makeing a serious decision pertaining to thier finances that they seek out information for themselves. Due to the fact that you never know who you can trust - then when you find the company who tells you the truth, the good the bad and everything) thats the company you use. Bad things happen to good people - lots of people every year graduate from debt settlement programs. (saving them from BK) Is it a possibility you can get sued (yes). If you can not pay your bills every month - you can get sued regardless -. Your credit score suffers (yes) with out a doubt, but for most people who NEED settlement worrying about their credit score is like worrying about the yard when their house is on fire. Can they make you pay taxes on the money you saved while in the program (yes). If I saved 20 or 30 thousand dollars and some one asked me to pay taxes, I would gladly do it. If you are insolvent you can fill out a form with the IRS to forgive the taxes. If you are able to pay your bills on your own - then you should not have been trying to get out of it in the first place. It is for people in a hardship. So yes their are risks with or without settlement for these people. On the upside - When utilizing a reputable company it can save you thousands. It puts money back in your pocket on a monthly basis so you can maybe afford your mortgage. It saves you years and years of stress with your creditors. On a twenty thousand dollar loan at a 15% interest rate its going to take 27+ years to pay back when all you can afford is the min. And you will spend over 19,000 in interest! They obviousley didnt give you all the important information, maybe some stuff came as a surprise to you and for that they suck. And (yes) from that point of view you got ripped off. Debt settlement however DOES work. I would suggest for any one getting into settlement to go with a attorney based program. (not traditional). Attorney based models are more regulated. Its obvious that their is a lack of knowledge about this industry from your recent comments.

I personally have dealt with Bernie Melendez on several business occasions and have found him to be refreshing. Totally opposite to all the crap that people say with ulterior motives. Like Driving business in a different direction! How hard is it to find true integrity these days? Well Bernie Melendez has more integrity than anyone else that I have ever met. To smear him is a shame. My posting is not anonymous!

Mr. Barber:

I'd like to talk to you about CS. I opened an account with them middle of 2009 and have paying $142.00 since then for service fees. I was able to talk to them over the phone couple of times before and they always kept telling me that I needed to open a savings account to save money in order to pay off the settled amount. But they never got back to update on my situation, and now I am not able to log on my account to check on my account with them, have sent to them many emails, faxes, letters and nothing works including expending a lot of time over the phone to see if I can talk to any human voice at CS. I hopefully found out about the crude reality about them by doing a search today and my suspicions were true: that they are simply crooks. Could you tell me how can I join a class action suit agains them in Texas, if it is one going on at this point?
Thanks heaven I did not open the savings account they demanded otherwise they could've stolen from me more! Commonly crooks, thieves, and the corrupt are not only found in bad neighborhoods but they can also be found in elegant offices wearing suit & ties. They have screwed me very badly and may have to go for BK unfortunately.
