i have a payday loan with oneclcick cash i owe them 250.00. also Emerald marketing 300.00. also Arrowhead 150.00. I had one with purpose loans but they said there was a glitch in the system and i have zero balance with them I never even made a pmt to them. My boyfriend has two BMG and PLATNIUM B together totaling 500.00 he has made no pmts yet he just got them and realized it was 30 per hundred. These are not our state fees. were not trying to get out of paying just get the fees right with lawin my state CA. Does anyone know any templates letters requesting balance paid in full or to lower the fees to the laws of CA NONE OF THE LENDERS ARE Licensed IN CA! WHAT DO I DO!

im so embarassed! I promise god if i get out of this payday loan situation i will never get another one. Sad

I have only made pmts to oneclick cash 50.00 and the amount i borrwed was 200. Arrowhead in due 10/25 45.00 refi charge. Emerald i defaulted on the 10th havent heard anything yet. THis is allbecause i lost my job..

You will find some samples in the letters section and also a template letter in Polly's blog.

If you have checked that none of the lenders are licensed in your state, you have got a strong hold on them. You are supposed to pay the fees and interests allowed by your state. Draft your proposals putting the laws of your state and review your bank statements. Then you should be able to claim for a refund from the ones who have been paid excess amount.

You can try asking if they would be willing to work out a payment arrangements with you. There are a number of people on here who have been able to negotiate this with pdls. The hurdle will be getting the payday lenders to agree to payment arrangements for what you "legally" owe them per your state's laws. You can advise them that you are prepared to file complaints with your state's Attorney General as well as the BBB and California Dept. of Financial Institutions for engaging in small loan lending in a state they are not licensed in, and charging illegal interest rates for your state.

Some of the pdls are more accommodating when they know you are aware of the laws and that they will have to responds to complaint investigations from these organizations.

..not on civil cases like this. This is not a criminal case for which a person can be sent to jail. There are no debt prisons in US.

Tasha-If your in California and they are not licensed in CA first file complaints with the Ca General Attorney and the CA CDC (CA Dept of Corporations). The CDC is great, the PDL Company who was harassing me and clearly in violation of CA laws backed right off! I've been advised to seek legal council and sue them since I paid back over 4x the amopunt loaned and they still wanted more than the original loan amount. Good luck

Send them your settlement letters, if they are illegal in your state then you are only obligated to pay back the principal you borrowed. They are going to threaten you with fraud charges and arrest, but it is an empty threat, it will sound scary, but nobody is going to arrest you. Have you blocked them from your account or opened a new account yet? That would be a start. Just get your settlement letters out, using the template letters on this site, and then begin negotiating a pay back schedule with money orders to their physical address, just keep demanding this is the only way to make payment. They may resist giving you an address, but in the end they will give you the address to send in your payments.

Back at you! Also it is important that you file complaints with your AG's office against each of these companies if you haven't already. Include this fact at the end of your letters that you are going to send to these companies.
