I just got off the phone with Jimmie from nationwide cash who was a bit testy about the fact that his company did not have to follow any laws but New Mexico and it would take too long to go into how much I paid them on a 300.00 loan. I told him that I had the time - by the time he finished going over the payments I was up to $900+ dollars - on a $300.00 loan - I think that he was floored. I told him that I wanted him to e-mail me a dv, but he said that I had to put it into writing - I e-mailed him. He also said that I had a lot of nerve! I guess I do.

So Jimmie is saying that you have already paid $900 on a $300 loan? What state are you in? I would demand a refund from Nationwide Cash and file a complaint with your AG's office.

I received a call and email from a Liz yesterday from Nationwide cash Recovery dept. The email stated they will settle my loan for $240.00 or if i don't respond they are sending me to their legal dept. These loans are prohibited in my state and I guess they don't want to follow US Laws. Any advice, since they won't give me a pif. I already filed complaints with the BBB and AG's Office, but no response from them yet.

Its funny I landed here because of Mr. "Mitchell" at Nationwide and his threats. I have never heard from them or OCC since late June even though I have sent them a DV and follow up letter, I don't like silence

I am in Ohio and yes I filed a complaint with the ag's office here and also with the FTC. In my e-mail to Jimmie - I told him I was also going to call all of the major tv networks - you know 20/20; Dateline; 48 hours. etc., even Americas Most Wanted. It didn't help - they still hit my account!

I used to get harrased by MR. Mitchell too. I guess he has given up on me and now sending me to someone else. I guess i am going to email this Liz person and tell her the same thing i told mr mitchell. They got enough and it's a lost cause for them to continue calling me because they have gotten enough.

i dealt with these people and last time i heard from them (dave) said the manager was reviewing my case and then last friday they hit my account 8 times for a total of $365.00.

i had just "closed my account on thursday after it was more then 800 overdrawn, so now i have a negative balance of $450.00 due to this idiots.

B of A paid five of the transactions even after i told them i did not authorize them...so i was told by b of a i will not be responsible for any of those fees but i'm skeptical they havent been really helpful.

the best thing to do is harass them and email them as many times as you can, to all the emails you have and the customer service email. thats how i stop them form calling me, and i was even told not to call them anymore.

I was just on the web site for New Mexico's ag. I am going to call the 1800 number and register a formal compaint with them. I think that if I read their law on lending correctly 12.2.108 section K, that nationwides practices could be illegal there also. I am calling as soon as I get a break here.

Well - I just tried to call the 1800 number and it cannot be reached from my calling area! Well I guess I will have to mail my complaint as I cannot find an e-mail address for the New Mexico ag's office.

Irish--You can use the "Free phone calls" service on this website...The call will be recorded, but they can post the call on here and we can hear what the AG has to say.

And to add the cherry on the sundae, my cell phone rang yesterday--and it was someone from Nationwide asking if I still wanted a loan with them?? Huh??????? I told them no in record time, but started thinking that perhaps they're getting a little desparate?? It was amusing!

I have lots of problems with nationwide too..they told me not to e-mail them anymore and they were going to send me to collections..I paid them their money $360.00 on a $300.00 loan..Lynne said she didn't care that I filed complaints against them with the NM AG and the FL AG, but she also said:
Let me remind you that the loan contract you signed was very specific. This loan is subject to New Mexico law - not the laws of your state. If you wanted a loan subject to your state’s laws, you should have borrowed from a lender in your state. Nationwide is a New Mexico lender.

We operate from offices in Española, New Mexico, where we are licensed to under New Mexico’s Small Loan Act of 1955. Our regulator is the Financial Institutions Division of the New Mexico Regulation and Licensing Department, which conducts annual onsite audits. In contrast, we have no employees, agents, facilities or accounts in your state. In fact, our only connection with your state is that you live there. Simply, we do not fall under your state’s jurisdiction.

According to our lawyers, even if the choice-of-law clause in the loan agreement wasn’t valid, these are still New Mexico loans. This is because all of the critical elements that comprise a loan transactions - domicile of at least one party, analysis of the application, the final act necessary for contract formation, disbursement and repayment - all occur in New Mexico.

We would not have made you a loan if we were not 100% certain it was legal and enforceable. We have a valid claim against you and we are not going to simply go away. I strongly suggest you quit playing games and start resolving this matter now.
