These guys called me after 9pm and refused to ID themseleves when I called back. So I got online and found this posting. Thanks for the info! Someone has fradulently opened a Macy's account in my name and I told the company this in writing. When I told the rep I was reporting them to the FTC and attorney general they immediately gave me a supervisor who was the nicest guy in the world, big suprise! These guys must have lots of complaints. Keep reporting these folks!

Hi. I am so glad I found you guys. These people are calling me for Macys which is understandable because I defaulted on the payments because of cash flow issues. They are trying to force me to pay monthly payments than I can afford. What can be done. I am only able to pay them $250 but they want $500. I told them if I could do that I wouldn't be talking to them I would still be talking to Macys. Is it against the law to continue sending payments to Macys directly?

This info is valuable. I actually filed Bankruptcy and it was already adjudicated with a final Discharge order. Does anyone know if a collection agent can call you AFTER the bankruptcy is over? I know they can't call while it is still pending.

If your bankruptcy case resulted in a discharge, then all creditors with notice of the bankruptcy are discharged and collection on their claim is barred. A frequent problem is that creditors sell their uncollectible debt to other companies, without sending the information that the debt is discharged in bankruptcy.

Generally, if you provide the collector with a copy of your discharge and a copy of the schedule listing the original creditor, they will cease collection. If they don't, they leave themselves open to an action " lawsuit " by you for damages and attorneys fees.

Been a while since any activity on this thread, but I'll share my two cents anyway - I got a call from an "unknown" number. Since my son's school often shows up as "unknown," I answered, and a recording began playing even before I had the phone up to my ear. The woman IDd herself as "Sandy" and said "I've been trying to reach you for *quite* some time," sounding very frustrated and frazzled. Gave the 1-800 number and said, "extension one-one-f[CLICK]."

So it's not an actual human who's not paying attention to the niceties of leaving voicemail; they have an auto-message thing that starts as soon as you pick up the phone, cuts itself off before the message is complete. Not very effective at all.

Adding to my confusion are the facts that (1) I have no outstanding debts that I am aware of, (2) this is definitely the FIRST time "Sandy" has ever tried to contact me, despite her statement of trying for "quite some time," and (3) I see that Macy's is the creditor that most commentors have mentioned; there's not even a Macy's in my town, or for about 500 miles as far as I know!

I am an employee in the collection industry and all these postings are rather "amusing". First, for those of you that owe the "Valid Debt", calling you everyday is legal behavior according to the fdcpa (most of you debtors know what FDCPA stands for) and you need to pay your debts and quit calling the phone calls "HARASSMENT". It's amazing how you can take the time to complain, but you can't find the time to get the money together to pay the "Valid Debt" back. Where are you finding the money to pay for your internet?????

Secondly, if you have filed Bankruptcy, the original creditor does not always supply the collection agency with the necessary paperwork, which will result in an attempt to collect a debt, either by a phone call or letter. As soon as the debt is placed with the collection agency, they will send a validation letter to the mailing address that the original creditor has provided the agency with. Therefore, it is your responsibility to update your creditor at all times of any address changes. Once the debt is placed with the agency, they are attempting to collect a "Valid Debt" until you provide the proper documentation. Upon receipt of the documentation, all communications will be ceased.

Lastly, for those of you that don't owe the agency any money on any "Valid Debt", why are you getting so upset about a phone call or two? Again, the agency has the right to call everyday. Until it is communicated to the agency that the they are calling the wrong number, the calls will continue. "We are not mind readers". Simply call the agency and let them know the phone number they are calling and they will remove your number, so you will not receive anymore phone calls. Don't call them back and yell at the representatives and refuse to give them the phone number they are calling you at or leaving messages on or try to block your phone number, otherwise they cannot remove your phone number from their system. Simply, give them the phone number. The person that owes the "Valid Debt" may have had your phone number at one time or they may know you or have known you and gave your phone number to the original creditor as a contact number to reach them at. Why get so upset about your phone number being called? If you know the "debtor" why get upset at the agency for calling, you should be upset with the "debtor" for giving out your phone number!!!! Would you get this upset if someone delivered a pizza to your house and it was the wrong house?????? It's funny how consumers have given collection agencies a bad rap, when in fact consumers are the ones with bad behaviors. If you owe money and your debt is turned over to a collection agency, expect the agency to demand the money be paid back. They are not Customer Service, if you want that type of service, then pay your bills on time and stay out of collections (regardless of the reason).

"YOU BORROWED THE MONEY, NOW PAY IT BACK, YOU CAN ONLY RUN AND HIDE FOR SO LONG"

Wow, I am seeing so many FDCPA violations here. I would contact an FDCPA attorney (I can't post links but legalhelpers has been great).

They started calling me on the day I was laid off and yell at me this Ms. Norton. I told her to give me time to get my head together and I'd make the payment and she told me to get a lawyer she had to have the payment now. Then she called my ex husband and told him I used him as a refreance "as if" so I called Fashion bug the company I owed and made a payment Omni called back a a week later they called the ex husband but not me at all. So I called back spoke with Don and he was nice said he saw I made a payment and took the ex husbands number off the account and not 2 hours later Ms. Norton called back and yelled at me told me I was not allowed to tak with any one else on this account because she was the account manager and again told me to get a lawyer because I would make another payment again. So I called the FTC and non the Oklahoma Att. Gen
