What happens if a debt actually goes to court. Does the court decide how much is to be paid out? Does the person who owes the debt go to prison if he cant pay it? How does the whole process work?

For any debt issues, one can't be sent to the jail. The court will see if there is any way to work out something between both parties. If this is not working, judge will review your income, expenses and other necessary documents that give details about your financial standing. Usually, wages garnishment is done when there is no way of getting the money from the debtor. The laws vary in each state and the maximum amount that can be garnished is up to 25% of the disposable income. This means that money for your basic needs will be considered before a writ of garnishment is finalized.
Finsfan works in the HR and she knows about wage garnishment thing. She will be able to explain in a better way. Take her advice, she is confident in this matter.

Thanks for the info. I hope it never comes to that for me. I'm in a program now, hopefully none of my creditors get to the point of sending it to court.
