Hello,

I have written this settlement letter that I plan on sending to my creditors in attempt for settlement

I would like an expert to please check and see if it is tactful enough and if it will be successful in achieving settlement.

Creditor has reported me as having the above listed account in a derogatory state. It is my desire to bring this account to a resolution that will be fair and beneficial for all involved parties.

I propose a settlement in the amount of (amount here) USD. In exchange for accepting this settlement, creditor will report to any and all credit reporting agencies that this account is paid as agreed. I will not agree to accept a 'paid p & l' or 'charge off' for additional time on my credit report. It is my position that I have suffered enough as a result of this problem.

Due to housing, transportation, and general life expenses $(amount here) is the maximum that I can offer. If you agree to the terms of this settlement, please sign and date below and send this letter back to me. I will send a cashiers check for the settlement amount via certified mail within 30 business days.

yes and no. working in collections, usually all you have to do is call and offer a sif. if they accept it you will request a letter faxed or mailed and you will have anywhere from 7-30 days to respond. so all you really have to do is call. hope i was helpful, see when you write a letter, they know you are concerned about you credit and are less likely to offer you a settlment. In turn they will offer you a payment plan that they think is suitable. You want to ask.

I see your point about how they might try and offer me a payment plan. My concern is I will pay them and not recieve a letter within a reasonable amount of time (reasonable to me is 30 days) which is why I thought sending a letter may be better so that I have a paper trail before I even pay them that a settlement was reached.

How do you advise I proceed?

I believe communication in both ways is necessary. Whether you do it in writing first or you do it orally. There should be a follow up of all arrangements done.

If you are worried about sending a payment and not received anything in writing from the company, you will always be able to dispute and get it arranged. You will have proof of the payment done and the company not posted it to your account.

But you don't want to send money for a settlement without knowing that they will settle, you want to talk to them on the phone so that you can negotiate. if you send them a letter you might not like the response but if you call, you will be able to give rebuttles and make points, show emotion and negotiate.
