You are right Pink Lady - this is nonsense! That is why my hr person called me and I in turn called my attorney. He said "show me a judgement". I also re -emailed the c/d letter and wage revocation. They sent me am e-mail back wanting me to negotiate! I had an attachment on the e-mail regarding my attorney's info and to call them.

yes this is what she told me a letter of demand not an attempt, not wage assingment not a n garnishment or any thing i told them i will sue if they let this go through, is that right or am i wrong? tell me what to do. or say for that matter.

irish what do i send them do you have the fax number and the revoke letter i am at work and dont have the one i sent first but i want to fax something again there is no jugement or if so she didnt tell me what is a JUDGEMENT what does it do i am not stupid just dont know legal stuff that good.

My mother works in HR for a company in Illinois so I asked her if she has ever seen a Demand letter. She said that is what a company gets before a garnish is supposed to happen. If the employee agreed to it and the HR department has something with the employee's signature then it doesn't have to be court orderd. She also said prior to receving the demand letter the employer and employee should have received a letter of intent that gives them 20 days. Also the employee has to be so far behind on the payments before the garnish is honored, also there are rules on how much can be taken from each paycheck. So I would ask your employer if they have something in writing showing that you agreed to this since it was not court ordered.

thanks pinklady i would not have even known that they had sent the demand if i had notread the thread before s o i just call to see if they had sent a letter for me she said yes, as your mom what i shoul d do i have gotten nothing i have not areed to any thing can this lady in hr just let them take the money and can all the payday loans do this, if so what about the ones that has ben null invoid they may try this too. so i need to know what to do short of filing bk i will do that next.

Ask your HR person if this was the only thing that she has received from this company. Ask her where the letter of intent was prior to receiving this demand letter. Tell her you need for her to explain how all this is legally possible without you knowing about anything.

Pink Lady - in my case they just threatened to go to the next step. No letter, no e-mail , no phone call. I explained that I was in the first stages of filing for bk, as my attorney instructed me to do and I gave them the number he gave me for my creditors (both in writing and over the phone) but they choose to ignore everything. My C/D letter, my wage revocation etc.

You know i was once garnished $683.00 by Sonic Payday loans. I had been a customer for 7 months, i missed once finance fee payment and they started calling threating, it wasnt even a month into it that they garnished the entire amount without letting me know first or allowing me to do something about it. This was after setting some payment arrangment date to repay my loan. Anyway, my HR manager never let me know, she just did it. When i received my paycheck i question her about the amount, she then from a file pulled out the request for garnishment....since i didnt know the laws back then i just let it go.
