I just had a call from my HR Director about a letter she received from CTC demanding that my company send them money! Not a garnishment, but they wanted my check! I told HR that I was filing bk and under no circumstances send these people money. My HR Director said that she would deal with them.

Just when I started thinking that CTC is been unusually silent this month, here they come with a bang!!

I was assuming that the legal authorities have started investigating on them. Irish, you were lucky that your HR director contacted you before he would have sent money. Did you write a letter to revoke their wage authorization?

Actually I sent one to ctc, that they ignored, but my HR director said she gets things like this all the time and always ask before doing any thing. Also - they won't garnish here without a valid court order.

CTC more often tries for a wage assignment rather than garnishment. They know it very well that court orders is necessary before garnishing anyone's wages. If they have already ignored the previous letter, send one more letter, this time through certified mail and return receipt requested. You'll have proof of the date when your letter was received by them. Send a copy to your payroll also.

I am calling my bk attorney. He will handle it for me. My company does nothing without a signature, and they only count hand written and matching what is in payroll as a signature. I am also going to e-mail these fools - I have been telling them for 2 months that they will not get anything from me. I knew that it got awfully quiet!

Almost 3 months and I don't think that they were over paid.

Pay off the outstanding balance. This way you'll remain safe and you can't be sued if they take you to the court. However, there is least possibility of taking you to the court because they have violated the laws so many times.

Irish, I would let the attorney handle them. They are not going to be able to collect when you file. KYSIDE38

I also am filing bk but these people keep harassing me. My HR/manager is great about handling these people and won't give them a red cent. I hope more people read this forum and stay away from pdl/ipdl. They are trouble.

With the help of God, I am going to pay off my attorney this week and I will be filing soon, so this matter will be taken care of. Then I will never again do this to myself or my family! These ipdls/pdls are the arm pit of the universe!

irish,

That is an interesting way to put it, but true in fact. It seems they are getting pushier about getting their money back. I would let your attorney handle them. It's what you hired him for since you are filing bk.

I've never heard of a Demand letter, did your HR lady let you read it. If it's not court ordered then how is she able to follow through with it, especially if you revoked any wage assignment. If that's the case, I should go to my brothers job and demand his Payroll dept. to give me his check because he didn't hand over his half of the rent. It just doesn't make sense to me.
