I posted several days ago about how MTE sent me a settlement offer via e-mail. You guys told me about the cease and desist order, so I just thought I would share the response letter I sent to Rio and a few other places you will see in the cc notes on the bottom. I will keep you guys updated on their response.

I am in receipt of an e-mail dated 1-21-07 in which MTE Financial Services has offered to settle my account with TenDollarPayDayLoan.com for $9.00. However, I have become aware of a cease and desist order issued from the Oklahoma State Department of Consumer Credit to MTE Financial Service in which all loans issued by MTE Financial Services are considered null and void. Furthermore, as mentioned in the attached letter, the debtor is not obligated to pay neither the principal nor loan finance charges and also has a right to recover any payments already issued. I have paid $300.00 in principal and $60.00 in interest and fees on a $300.00 loan and expect a refund in the full amount $360.00. I am also demanding that you remove my name as a negative account from Teletrak and any equivalent consumer reporting agency. I am sending a copy of this letter with your e-mail correspondence dated January 21, 2007 to the State of Oklahoma Department of Consumer Credit, the Oklahoma branch of the Better Business Bureau, and the Oklahoma Attorney General. I am sure they will be interested to see that MTE Financial Services is violating their cease and desist order by requesting payment on a loan that is considered null and void. I look forward to receiving a full refund in the amount of $360.00. For your convenience, I am submitting this letter via e-mail and USPS certified mail.

I think MTE Financial has a hard time understanding what cease & desist means and that all of their loans are null and void.

Hooray Sheena! You go girl!!! I am glad that people are using those letters. Please let me know if you get a response. I basically sent the same letter that you did and have not gotten any response whatsoever.
Fedupinpa, MTE Financial is also Rio Resources, Ten Dollar Payday Loan, No Faxing Payday Loan and several others.
