I am in the same boat, much smaller amount, for a providian account. I did contact a lawyer, I just got the 10 day notice on the account. There was much more that proceeded. The attorney told me that he wished I would have contacted him earlier, he could have gotten it dismissed. However he did tell me to answer the court summons or they would win by default. I simply typed up a reply to each allegation in the summons, filed it on friday, with in my ten days and mailed them a copy. You will need to answer to this at the very least to the court. Don't be intimidated. It is a pretty easy process. Just make sure they do not win by default, if you don't respond they will. Answer each item and file it with the court that you are being sued in, it won't cost you anything to do this. For example: 1. Defendant is an adult who resides at yada, yada, yada. My reply: 1. Yes, defendant is an adult that resides at yada, yada, yada.
The attorney also advised me that I should not admit to the debt while answering to these allegations. For example. 6. Defendant owes plaintiff $******, with 6%, yada, yada. 6. declined
Reason, you don't put this in there, this card was charged off and sold. I did not apply for a card through them, nor do I owe the amount they are stating. Bottom line, they don't own the debt or at least they have not answered to my debt validation to prove they do. Hope this helps.
