I made the mistake of getting a CashCall Loan...

...and although I am current with them, they have been calling my home eight or more times daily because I haven't sent in this month's payment, and I haven't even gotten halfway through the 15 day grace period yet! I thought when I read the contract that you have a grace period of 15 days before a late fee of $15 is charged? I haven't even had that charged to me yet because I'm only on day 7 of the grace period! I will be paying them before the 15th, but they are calling me every day, eight or more times a day threatening me to pay now! My goodness, I can understand this if I'd missed a payment, but I haven't missed one yet, and I don't plan to! All this because I took out a $5,000 loan that I desperately needed (although, it didn't help me much with my PDLs mess). Anyone have any advice to share with me regarding CashCall? Can I stop them from calling me? Like send a letter to them telling them to only contact me via correspondence?

What can i do if i haven't been paying my cashcall loan? I took a loan out a couple years ago for $2600 and I've been making payments for 22 months so I paid them a total of $4026 so far. My bank account ended up closing because I didn't have funds for 4 days the day my bill was due. Because Cashcall kept trying to debit my account Wells Fargo closed it. Now I'm stuck... what can I do?

Yep...I got a Cash Call loan, too. ALL KINDS of problems with them!! They called my home, my work, my references ALL the time! This might help some of you. I'm in the military. As soon as I told my 'chain of command', the calls stopped. What Cash Call is doing is illegal. IF they do try to sue, they can't sue for more than the % rate that 'your' state allows. Some consalidation companies will not deal with Cash Call. I don't know if Debt CC will or not.

cece, you should of stop paying months ago, and I mean months ago, pay no more to these people. they cant do a $#%&^& to you for it. please be patient and someone will be along to explain what you can do and how these horrible people have ripped so many off here. hang in there, all will be ok.

Just clarifying a point here...

CashCall is LEGAL. They are backed by a bank, and because they are, they can get away with the interest rate they are charging.

Do not attempt to treat this company like a PDL - they are NOT a PDL company.

This company CAN and WILL take you to court if you default. The only good thing about that is that if it happens, the interest rate will quite likely be set back to the state-allowed interest rate...but you will end up with a judgement on your credit record - unless you go through mediation in lieu of going to court, and a payment arrangement is set up.

The court is not going to care that CashCall is charging outrageous interest rates. All they will care about are the facts of your case - CashCall loaned you money - you agreed to the terms in the contract - you defaulted on the loan - CashCall wants to be paid. (Please don't take offense to that statement, I'm not trying to be harsh - just showing how it would go in court.) Unless you could prove that you had been making payments all along, and CashCall had wrongly accused you of defaulting, CashCall will win.

Until a governmental body sees fit to stop them from this highway robbery, they will continue. And from what I have seen on this forum about them (never had a loan with them myself), they are ruthless when it comes to being past due.

Thank you for the info, SUEBEEHONEY 70. It's always good to have the info I need, to make decisions. The last payment, I made to them ,was in March of this year. If they were going to sue, shouldn't I have heard something by now?

Not necessarily, sdchargers....I would try to work something out with them if at all possible, or get into a debt consoliation program and see if CashCall will work with them.

However, you being in the military may be the reason they haven't pursued you. I know there have been policies put in place to protect our military personnel from payday lenders and high-interest lenders like CashCall. That may be the only saving grace you have. If someone else on the board knows more about what happens with CashCall when the military chain of command cuts off their contact with a debtor, please post it. Would they have the ability to pursue the debtor after they are discharged from military service, provided the debt is not out of SOL at that time?

Thanks for the quick reply. You may be right. My 'chain of command' did get involved with this one and ( basically ) the info went right up to the PA courts ( ? ) ( Lack of a better word, I guess). Good question.....would Cash Call beable to sue, after Military Service? I also do know there are several Payday loans that will not deal with Military personnel at all...because of the high %, etc. Do u know if Debt CC can help me consolidate Payday/cash Call loans??

sdchargers - there are several consolidation companies on our Ranking Chart that will work with payday loans. Did you take time to figure out if you have overpaid any of the loans yet? It's best to do that before you consider a consolidation program - why consolidate something if it should be marked paid in full for what you've already paid?

Ihaven't looked at all of the companies, in the Ranking Charts. I DO know I haven't overpaid anything..........on a few of them, I din't even hit the Balances yet, just paid all the fees, so far. As u know, with Payday loan, the fees don't 'count' toward the balances. Thanks for the advice.

sdchargers - if these companies are internet lenders, they MAY be operating illegally in your state. If so, you may have already paid them in full just by paying the fees.
