Blatt, Hasenmiller, Leibsker & Moore, Got a call from these guys today, trying to collect on an old capital one account. I am sending DV letter and cease and desist via certified mail tomorrow. Any way, I ask the lady for the fax number, it did not match the one I found on their website, so I called back to verify. The guys that answered the phone asked me why I needed it, when I told him what I was faxing, HE HUNG UP ON ME. What is up with that?

What are you writing in the cease and desist letter. Don't mention complete C&D. Allow them to communicate with you in writing only. If they know that you are stopping all correspondences from them, they will send your file to some other company and the story will never end. Have you called Capital One and see if something can be done there?

I told them that I wanted all communication stopped until they properly validated the debt. That is a really pretty picture you have there Bony, I want to walk down that lane, it looks so inviting.

Talk with Capital One. One thing you must try out there. If they agree to your payment proposals, you won't have to pay to this collector even if they validate the debt and if the account is with the original creditor.

This account was charged off years ago with capital one. This collection agency is just being the normal bottom feeding lawfirm that could not establish a real business, so they had to resort to opening a callcenter and collecting debt. I am pretty sure that I paid this debt once through another agency, I am trying to get ahold of them now to get confirmation.

Has anyone dealt with this company before? They have me on the auto dialer, shouldn't they take me off if I requested they cease communication.

they served me and tomorrow I have to go to court to deal with them. They keep on asking for $150/month. I make only $1000/month so 15% is usury and abusive. I wish I knew what else what to do. I keep reading online how bad they are.

I have a trial date with them in July. From the initial hearing with them, it seems that the are very organized and work like a machine. Make sure you have all your affirmative defensive if you go up against them.

If they send me proper debt validation, I will deal with them, they hung up on me when I called back to get the fax number confirmed. That really irritated me, they want over $1200 on a $500 credit card. That is nuts.

How long did they have your file before they started any litigation? Was it a capital one account?

Yes, it was a capital account for 6700. Initial amount was 2100. about five years old. However, they do represent other OC.

They actually represent Capital One. Capital one was listed as the plaintiff on the complaint.

BLHM,
Was your capital one debt charged off by the credit? Mine is charged off and capital one won't deal with me on it, I think these guys bought it. I had two capital one accounts and I paid the other one off to the other ca because they proved they own the debt to me and sent me a paid in full letter when the account was paid.

Got back a validation letter and called capital one, they are collecting for them. They are wanting $1200 but in the letter asked me to make a proposal, The original amount was $500, so I sent them a letter proposing $500 at $50 every 2 weeks. What are the chances that they will accept this? I wanted to start low and hope they accept it.

It has been a week since I sent the $500 offer, but still no answer from these guys. They are pretty nasty on the phone. Anyone else have any dealings with these guys?
