Tremont Financial threatening with wage garnishment

I apparently, still I have 1 more loan out there. It is with Tremont Financial and the original balance was $ 300 and I currently owe $ 200.

They are threatening to send the voluntary wage garnishment to my payroll department. I have more than paid back the principal of the loan, but my question is, should I just set up a payment arrangement to get it paid (by money order or western union or something, I will NOT give them my checking account info).

Here is the interesting thing, when I got the loan, I lived in Maryland and I have since moved to Florida. What state laws apply to this should I choose to fight it?

Thanks!

Leah - you are kinda right. It is the state you are in when you take out the loan. You could live in say North Carolina, but go to South Carolina and take out a loan. The laws of South Carolina would apply.

Be informed of the laws in Maryland and go through the fine print carefully. Wages cannot be garnished without court orders. They might be threatening you with wage assignment. It is voluntary and you can legally revoke it. Send a revocation letter through certified mail and return receipt requested. Then, you can work out with them on some other payment mode.

Tremont Financial does put a wage assignment in their contracts. Also check your state laws, wage assignments could be illegal.
