I read online that wage assessment is voluntary and wage garnishment is court ordered. Is that accurate?

That is correct...and unless you have received a judgement they are using your voluntary wage not a garnishment!

Yes, but the laws vary from one state to another. You should get the applicable laws from your local AG.

I'm interested, because the cover letter from my payroll department states "required by law to process this garnishment" on the last page that is provided is the sheet payday ave sent them which sites "Declaration of wage assingment."
I can't believe the lady at payroll was giving me such grief. Their cover letter should state wage assignment or the page payday ave gave should state garnishment. I hope when I speak with payroll tomorrow I get someone different. OMG
