The creditors can sue you for the money that is owed. This will result in a judgment, which could lead to them garnishing your wages. This does not mean that they will take your assets. They could freeze your bank accounts. So when they sue you and you own nothing doesn't mean that they won't get what they want, they will find a way to get it.

debt settlement is not alway the way to go. A debt settlement company will take your money and put it in an account till you have enough in the account to offer a settlement. Alot of the time a creditor will not wait that long before they sue you. Now with a debt consolidation company will send out paperwork to your creditors with an offer and the companies can accept it, refuse it or counter offer. This way the creditor will know that they will get paid something every month.

Like I said earlier sometimes a person has no choice to file for BK. ANd in most cases it is because a person has little to no assets and little income, so that would be the best way for them to go. The choice is theirs, but the BK lawyer will be the best source of information to tell them which way is best for them to go.

this is my last comment on this topic. see if the laws for filing bk have changed from now to 89 so be it. but the fact remains if settlement dont work and you are willing to pay them that and they sue you and you qualify for bk 13 is the same as paying or conversion to bk7. i have been there and done that so im not saying bk is for everyone what im saying its not as bad as you may think. one of the nicest part of getting bk over with is knowing you have zero bill and i do mean zero bill you can sleep at night and you next call is not from a creditor or collection agency. so if you cant settle using a settlement co and they sue and you qualify for bk i would but thats up to you and a lawyer do decide. good luck everyone in you plite to get you bills down but once there gone it feels like 100 lbs was lifted off your head so give it all you got and i would not worry about bk for me it was not as bad as it sound ps you can get your credit back in small steps but it will come back my came back within 5 years im supprised the amout of views in a 26 hour period

Every situation is different. As I have been on this forum, I have 'encountered' people that WAY more debt than I do. Maybe..in their situation, 'settlement companies' din't work, so, they file for BK. In other cases, I have 'seen', 'settlement' companies DID work. No one, on this, forum is judging ANYONE ELSE. In my opionion, everyone's experiences and knowledge is priceless to me. After starting with DebtCC, I sure sleep alot better, knowing what CA's ( etc), canLEGALLY do and NOT do.

SO IF YOU ARE LOOKING FOR A WAY TO STOP CREDITORS AND COLLECTIONS TO STOP CALL YOU THERE IS A UNIT WHICH I PURCHASED ON THE INTERNET YOU NEED TO SEARCH TRY SOMETHING LIKE BLOCK CALLS ITS NOT A SERVICE BUT A BOX. LET SEE IF THIS GETS REMOVED. PS I HAVE IT AND WHEN THEY CALL MY PHONE DOES NOT RING AT ALL. HOPEFULLY THIS SHOULD BE WITHING THE GUIDELINES OF WHAT I HAVE KNOW IDEA.
