I had a judgement placed against me. The judge awarded the full amount of $2800 to be paid in monthly payments of $200. The creditor is asking me for $400 a month and claim they will take me to court. Can they ask for more than the judgement?

I was only late for a 1.5 month, Bank of America is already sending me a letter to threaten me about legal actions.

Here it is:We recently received your letter requesting that we no longer contact you about above reference acct. We understand that you prefer not to receive calls, and we will honor your request. However, please understand that if we do not receive a payment of $259 by August 26 2008. We may refer your to outside counsel for legal proceedings. This may result in legan action against you.

Do you guys receive this when you enter a debt settlement program?

yes! The settlement said that if I get sued, they will file something to delay the court date for 2 years.

Oh....good to know. Someone with experience will be along shortly to let you know. Did you settlement company send BOA a power of attorney?

not yet! But they said if I really get sued, they will file something called (I might spell it wrong) "motion of repell" or something sound like that to delay the court data for 2 years.

Molina, I'm not sure of the answer to your question, but hopefully someone else will come along with some information for you. It seems to me that if the judge already set the payment arrangements, then that is the amount that you are obligated to pay.
