Default Information PLEASE!

I just called Campos Chartered and they informed me that I have to now contact Hess Kennedy. I had paid my 30 payments off in September and was calling to check up on settlements. I paid them $14,880 and am now being told that I might get a percentage back. Nothing is guaranteed. I am very worried about the entire situation, and while it's comforting to know that others are going through this it is incredibly troubling to know that this could happen to so many of us. Does anyone have a lawyer? Suggestions besides just sitting around hoping for the best? I hoped for the best with finally paying off my debt and look where that got me. I wrote down every person I ever talked to, what they said, all contact (letters, e-mails, etc) and will not sit by quietly! Any information or updates is appreciated.

dfawaz,

The sad part is, Chase had a lawsuit against Hess Kennedy and lost. Now they probably won't do anything. I did not know that Chase owned WaMu. I don't have the card anymore. WaMu calls my home every night (one of those computerized calls) and I am current on the bill. I think it's for electronic pay, and it will be a cold day in hell before I give them permission to do that!!

Allison,

It's in receivership. I don't think you can get a lawyer against them. Whatever the receivership is going to get is doing on the behalf of all clients that were formely with hess kennedy. Also Send the info to the receivership. All info you have. I did. I got a call today from one of there reps but i was at work. She stated she would answer all my questions.

Laurie P,

I actually have a collection Agency calling me now on behalf of my old debt. I DV them and have not heard anything yet. I sent it about 3 weeks ago. Chase could not get paid for what they didn't though. If you don't mind me asking how much do you owe to Wamu? I owed them 12k when I first started now it is up to 16k. Im not paying them 8 k either. I got a settlement letter for half. I will settle between 4-6k. Hopefully some of that will come from the Receivership

dfawaz,

Belive it or not, I only owe the 1700.00, but you would think it was 25K the way they bother me. I'm about to get a whistle for next time they call, which will be about 8:10 this evening like clockwork. I just can't believe the harassment on a card that is current on payments. I sent a copy of the letter on lbfmiami to my HSBC debt which was with Hess Kennedy, telling them that I was one of the 6,000.00 and to not expect any more payments!! Take that!

Laurie P,

I hear ya. Damn Collectors. I can't stand them. I made my mistakes and I would like nothing more then to be out of debt. But right now I'm in financial hardship. Half the time I want to tell them I'm filling Bankruptcy. You wont get anything now. B******. I do want these debts paid off. I made mistakes by running up my cards and thats my fault. But when I get penalties that are outrageuos thats BS. All these banks got bailed out. I don't want a bail out I just want some help.

dfawaz,

The problem is, we all tried to get out of debt with help, and that HELP cost me about 6000.00 in interest and a crappy credit history now. I was current on the 5 cards I gave to Hess Kennedy,
which kills me because now I've got a truly crappy credit rating, although one of the credit report agencies keeps telling me I'm dead. I said, "if that's so, then I can stop paying all my bills, correct?" I did luck out with the HSBC and CapitalOne forgiveness, but will still have to claim the $7,000 + forgiven as income next year, (which, by the way, was basically all the interest accrued sitting with HK). Small price to pay, I guess. Hopefully, we will all see some money back from Hess Kennedy, but I'm not holding my breath. I don't want a bail out either, but we definitely showed good faith by taking over when HK started screwing us around. I know about financial hardship, when it comes to buying food or putting gas in the car, and I work full time! justwhen I see a light atthe end of the tunnel, something else pops up to take that little bit of extra money. I don't know about you, but I don't see how there is any way for me to retire in 15 years, being single and 1 income with no savings. I'd have to rely on SS, if there is any left at that point! boy, I'm rambling.

Laurie P,

We did get screwed along with thousands of others. What is even more gut renching is that ***** is not even going to jail and you know she has more stored away on offshore accounts. As for the creditors you would think there would be some leway. Capital one and HSBC did the right thing. It's not like the companies didn't get paid. They both got over a million dollars each which isn't much in the corporate world but they will still get money for any money not paid in full. I still have a little while before I retire. SS will not be there for me the way it is going. I know your credit may be hurting now but it will get better once you get everything in line. My Uncle had over 150K filed for bakruptcy and had to pay something like 50K back and says his credit is actually in good standing. This all happend over 7 years ago so there is light.

dfawaz,
I had a bankruptcy in 2004,but I was devastated that I had todo it. I had to get rid of my condo as well, even though when I bought the condo on a USDA loan I was told payments would never go up. I actually got the thing for $375.00 a month plus condo fees and taxes, blah blah..well, when I finally went bankrupt, my monthly payment was $650.00 and condo fees had gone from $110 a month to $330 a month. I'm just a sucker,I guess. I felt like such a low life for having to claim bankruptcy, but my lawyer at the time reassured me that I should have done so 10 years ago! He said I was one of the most stubborn, determined clients he ever had. Dumb is more like it. Your credit does get back on track.obviously, I didn't learn my lesson, and went out and got more credit within a year. But in my defense, it wasn't material spending, per say, just day to day expenses and needs. I will keep one card that has a low limit, but the rest that were with HK have been disposed of when I went into HK settlement program. As far as Laura Hess, I believe she is gonna have more**** thrown at her with all that's surfacing now. If not, I'm up for a trip to FLorida-how about you? ha

Sounds Like A Road Trip!!

Did you read the new post on the Website? I don't understand it very well. Are they trying to get us to signup for another debt settlement program? Call me dumb im not big on all the lingo.

Curious if you saw it.

dfawaz,
I just read the article and it sounds to me like they are trying to get all the"current" Hess Kennedy "victims" to stay in keeping with a debt settlement program if they can get a reputable firm to pick up the mess and continue on.I am not real savvy myself on this stuff, but that's what I got out of the article.I just want to see some money back that SHE spent while putting me further into debt.

Laurie P,

I would befor it if they put everything that I paid hess Kennedy. Other then that I will take some of the cash and try to negotiate the best I can.

dfawaz,

I'm not going to push my luck. with 2 CC's forgiven, and not being in the program anymore, I'm very leary of any debt settlement program right now. I have 2 cards left to pay off, one being WaMu (uh!) and another being Juniper, both with small balances. I'm wondering if people will have a choise if they were still with Hess when it folded. I hope so. I'd like to see all my 2100.00 back with the claim, but I do not think it will happen in full.

Laurie P,

I understand your take on it. I gave over 9k to them I'm hoping for at least 6k. I won't hold my breath. One thing I thought is if this did go through a debt settlement company came into play and screwed me, I would go after the State of Florida for recommending it.

I, too am in the same boat. I sent my papers in to the receivership, but I just don't know what to do next. I've been getting calls and not answering. What really concerns me is that I have received 2 letters from collection attorneys, Frederick J. Hanna representing Chase, and Apothaker representing Discover. I have read some about DV letters, but really don't understand. Can anyone give some advise?

Welcome Pam V,

I understand your confusing. I was in the same boat as far as being confused. You have come to the right place. Everybody here is here to help. You can send them both DV letters. Basically you want them to prove they own your debt. You don't want to pay anybody anything and have someone come back and say you owe them. Check out the do it yourself tools for the dv letter. What you are doing is just asking for validation for your debt and not refusing to pay.

I am ready to do the DV letters, but I'm not sure if I should go along with the sample letter saying I was going through my credit report, or am I sending the DV letter in response to the letter they sent me. The letter I was sent states the company they are representing and the amt owed.
