What about the amount, etc..did status change on that, or is it "not yet determined" on amount to be paid and amount allowed? Got laid off last month, so very eager to see something turn my way.

Hi Laurie,

I still have not yet determined. I contacted the office and was told that they will most likely start getting money back around mid april. We won't get all of it back but we will get some. I have 9.3k invested. Right now I would be happy to get half that.

these people ha delt with my hard earned monies, they really dont know how we work so hard , then for them to frawd us. we are innocient people who wants to pay off their debit, and to make a fresh start. instead they promise us to help us, by paing them rigilously, then they can live happy with our money. I have sent faxes, letters, and many phone calls, they have never sent me a post card letter of claim, i have seen on line where people are getting back their money as of march. Now I need mines, who can give me some good information, I am really desperate. Thanks to all.

I just checked the LBFMIAMI website and nothing will finally be paid till at least 12/31. You can look up receivership and hess kennedy. It gives an explanation of everything.

Hi, I have a lawyer now and will file BK next week after being jerked around by Allegro Law. Last year, Stermer's office sent me a letter that one of my cap one accounts was 'forgiven' and in subsequent conversations with Cap One reps about that and other accounts, they confirmed it was forgiven. I check my report yesterday, and that "forgiven" account shows a large balance, over $4k!! Anybody experience this, or know what to do?

Send a copy of the letter to the credit reporting agencies and request them to remove the offending mark immediately, per the Fair Credit Reporting Act.

Did you get a 1099? If not, what exactly does that letter say (aside from personal info, of course)?

No 1099 received, but the letter said that it may take til early 09 to show as clear. The letter basically stated he was the receiver for Hess/Kennedy, that this account was forgiven, that reporting agencies would be instructed that the debt was contested until early 09 when they would be able to clear it. It also stated that it affected only this account, and no other cap one accounts we may have. Since it wan't clearing til 09, I assume I may not get a 1099 til next year.

I keep seeing misinformation on this page. The LBF Miami site clearly states monies will be paid back to us BY 12/31/09, not after. It's really quite clear, just go to the site and read it: lbfmiami.com/active_cases_receiverships_hess.html
That page supposedly contains all the information LBF has on this case. They update it about once a month.
Personally I'm really holding out hoping they'll settle with the companies I'm indebted to as they did with HSBC and Capital One. I'd hate to file bankruptcy then find out a month later my debt would have been wiped out... Eeek.

I read it wrong you are correct. Money by the end of the year. I hope I get something back. I have a CA Breathing down my neck and have been playing hardball with them and want to settle and would need some of that cash to settle. You think the CA Would have some remorse because they were dealing with Hess Kennedy before this shit happend. But they just want there money like leaches. Figures!
