I am another victim of the credit counseling scheme. But anyway, you can fax your new address to: 954-344-8427 Attention to Claims Department--must include your claim number, new address and phone number. You must do this very, very soon. Checks will be mailed out 12-31-2009.

I am still working on trying to get Capital One and BankofAmerica accounts off my credit. They already reached chargeoff status, which decrease my credit score tremendously.

I've received everything from DJS's law firm that they said I would; and NOTHING from Hess-Kennedy that they said I would. I had 5 credit cards with Hess-Kennedy and DJS firm reached settlement agreements with 4. I contacted another and negotiated a settlement with them. I've yet to check my credit report, but was told that all creditors should have reported a $0.00/paid in full account by then.

Guess I have no-one to blame but me for the $$ I lost, but more than $10,000 to Hess-Kennedy and I'm seeing such a small fraction. What do they say? Live and learn and REALLY learn.

I think a settlement agreement was reached with Capital One. I didn't have them, but did have Bank of America, Chase and Target. I did hire an attorney to settle with Bank of America and I'm making manageable monthly payments. Chase settled and I negotiated a settlement with Target without legal representation. The website that talks about Capital One is:
http://www.HessKennedyReceiver.com/narratives2.html about 3/4 of the way down the page

I've talked with them on several occasions and have been in e-mail and phone contact several times with DJS and members of his staff. I've also followed the proceedings on their website and am convinced that he's legit; not like Hess-Kennedy. In fact, the person who called me (not the account executive) from Hess-Kennedy felt extremely sorry for what was happening. I'm normally quite a cynic and it takes a lot of convincing, but I feel convinced that they're legit.

For some of us who had money with the Consummer law firm. I just found out that the Hess Kennedy Receiver is paying back only 25% of what was sent. I am afraid this was just a scam!!! How will the court of Miami allow people to receive only 25% of their money? This will hurt some of us here. How can we get our money back? And how will we pay our debts back?

I hate to sound ignorant, but at this point in time I am completely in the dark as to what's happening with this whole situation. The last thing I heard of any of this was when I received the "postcard" with my claim number on it and a letter stating this mess was supposed to go to court in November and if there were anything I was going to be able to recoup, I would receive it sometime at the end of this month. I'm beginning to feel as though I can just kiss my $2,800. plus good-bye, and chalk it up to another life lesson where I was trying to do the right thing and got screwed. I hate to sound bitter, but I'm disabled and live on a minimal S.S. check with no increase in that this year thanks to our Pres. who says our economy wasn't bad enough this past year to warrant one! When it rains it F%*#@ng floods my basement! Appreciate any news anyone can share with me.
Thanx

The way I look at it was that it was me, only me, who charged more than I could afford and I'm darn lucky to be getting some money from the Receivership (DJS) back, as opposed to NOTHING and continuing indebtedness to the credit card companies.

So, even though I'm only getting 25% back, the Reveiership has reached settlements with 3 of my credi card accounts (Chase) and I've reached settlements with 2 more.

No, I've not received the $$ yet, but it's supposed to be mailed by 12/31, so I'm a few days early.

Laura,

On their website, http://www.hesskennedyreceiver.com/ almost to the bottom of the page is a link to their claim # status. A few weeks ago, I saw where I'd be reimbursed for 25% of the original $10,600 that I paid the Consumer Law Center and that the checks are to go out on or before 12/31 to the last recorded address they have for you.

check the site http://www.hesskennedyreceiver.com/narratives2.html . I believe about 3/4 down the page, the Receivership addressed that a settlement had been reached with Capitol One. I didn't have an account with them, but did with Bank of America. Bank of America settled for some 70% of the hefty amount I owed.

However, I contacted Target myself and settled my debt for 30% of what I owed them. Chase bank has agreed to write off the credit card debts and I believe that's what Capitol One did, too.

As far as I know, it takes a few months for 'charged-off' status to change to $0.00 balance on your credit report and then the derogatories on your credit report stay there for some years after that.

I think that we may have tried ourselves by putting them into receivership. . from what it looks, a debt settlement plan takes 3 years to complete. . 2010 would have been the third year with the company.

The debt management business is booming if you read the report.

check with your state cosumer agency advocacy group, they may be able to help you for a flat fee sometimes as low as a few hundred. They won't get you the 60% discount that was offered by these a$$hole$, but you'll know it's legit. If your situation is really dismal, I would also LOOK into BK, but know your options and your consequences with taking this route. Best of luck to you.
