I had a credit card that obtained an attorney to try to collect an account. The attorney got the account a little over 45 days ago. They sent me their letter stating I had 30 days to request validatin and so on and on. I did, I requested validation, proof of entire balance and what did I get? Nothing until today, I was served by sherrif court summons papers.Yes they are legit. Now what do I do? I sent the validation request over night mail, got delivery confirmation and signature confirmation within the 30 days.I have the original signature card the person signed.PLUS I KNOW the account has had no activity in over 3 years.I know it was May 2005 when I had to let it get behind and I have not done 1 thing on the account since. Now the credit card company has on my credit report 12/2005 as date of last activity which s wrong but still shows this month is 3 years by their dates. The summons papers I got today must be answered for by Jan.1 which still will put the account in Jan., based on my credit report, over 3 years.I have nothing on account it has been so long I lost all statements and papers but I KNOW it has been over 3 years. How can I request them to validate the account now since obviousely they are refusing to do so? Can I not request something to make them provide validation, date of last activity/payments and such? I do not know what else to do.I cannot afford an attorney and none will even talk to me to let me know if there is something I can file with clerk of court or how to file my written answer. This attorney did not send validation papers, did not validate any of the debt, is sueing me on an account I know to be over 3 years old, and I still do not know what to do next. The summons said the case is subject to non-binding arbitration, what does this mean? Can anyone help offer advice or knowledge please?
Thanks so much
